Breaking News:
 
On March 29, 2020, the US Department of Labor (DOL) issued clarifying guidance on the definitions of “Health Care Provider” and “Emergency Responder” (see # 56 and #57 of FAQ) as part of the Families First Coronavirus Response Act (FFCRA), which also includes the Emergency Paid Sick Leave Act and the Emergency Family and Medical Leave Expansion Act (EPSLA/EFMLEA).

The DOL has now clarified that Health Care Provider and Emergency Responder includes any/all individual(s) employed at (or via a subcontractor to) an LTC facility. That is, regardless of number of employees a community has, employees of the LTC Facility are exempt from inclusion into expanded coverage provided by the EPSLA/EFMLEA. 
 
It is not clear that this new guidance would apply to Independent Living facilities. Members would be advised to obtain independent legal counsel to work through that sub-issue.
