4th Annual "Pull for the Kids" Sporting Clays Tournament
Benefitting the Philadelphia Ronald McDonald House

The fourth annual M&SCA of Eastern PA “Pull for the Kids” Sporting Clays Tournament was held on Monday, May 21, and was once again a tremendous success. The tournament, which took place at Lehigh Valley Sporting Clays, was attended by nearly 100 shooters and raised over $14,000 for the
Philadelphia Ronald McDonald House, which
supports families of seriously ill children by creating a community of comfort and hope.

Killer Contract Clauses

The typical construction or service contract can contain thirty pages or more of fine print. Some contract terms in particular can severely impact your rights and, once enforced, can directly affect profitability. These contract clauses may impact payment rights, notice responsibilities, scope changes, and the right to recover for costs resulting from project delays. Cohen Seglias attorneys Matt Gioffre and Dan Fierstein will present a seminar explaining these Killer Contract Clauses, how courts will interpret and enforce them, and will provide best practice tips for managing a project to minimize the impact of these contractual provisions.

2018 National Issues Conference
|
The MCAA National Issues Conference, which took place in Washington DC from May 8-10, brought member contractors from across the country together to meet with legislators about the issues affecting our industry. Attendees from the M&SCA of Eastern PA met with representatives from the offices of Senator Pat Toomey, Senator Bob Casey, Congressman Brian Fitzpatrick, Congressman Ryan Costello, and Congressman Brendan Boyle. Issues discussed included Multiemployer Pension Reform, Paid Family Leave, Infrastructure Investments, and RFS Reform.
In addition to the meetings attendees heard from several speakers including Congressman Donald Norcross. Norcross is a co-sponsor of the GROW Act, which would authorize the use of hybrid or composite plans to strengthen the multiemployer pension plan system.

Two M&SCA-Supported Bills Head to the Governor's Desk
|
On Tuesday, May 22, the Pennsylvania State Senate voted to pass Prompt Pay Legislation (
HB 566) by an overwhelming, bipartisan majority of 43-5. The bill was amended while in the Senate, and therefore had to be sent back to the House for concurrence. On Wednesday, May 23 the full PA House of Representatives voted to concur on HB 566 with a vote of 175-16.
On the same day, the House voted 163-28 to pass
SB 234, which establishes Pennsylvania's Property Assessed Clean Energy (PACE) program, which is a financing mechanism that enables low-cost, long-term funding for energy efficiency, renewable energy and water conservation upgrades to commercial, agricultural, or industrial properties.
Both pieces of legislation will now be sent to the Governor's desk for his signature.

The Impact of Tax Reform on the Construction Industry

Major tax reform under the new Tax Cuts and Jobs Act was enacted and signed by the President in December 2017. Changes to Section 179 of the code are particularly relevant to HVAC Contractors. Use the resources below to make sure your company is as up to date as possible on this new legislation.

2018 ALI Scholarship Recipients
|
|
Every year, the M&SCA of Eastern PA grants 3 scholarships to the MCAA's Advanced Leadership Institute (ALI). The ALI is a world class, 2 week course for the leaders of our industry. Attendees will travel to Babson University in Massachusetts and be taught by industry and academic leaders.

RECALL ALERT: Honeywell Hardhats
|
|
Honeywell recently issued a recall for their type 1 Fibre-Metal E2 and NorthPeak A79 hard hats. They were sold in a variety of different colors. The Fibre-Metal E2 hard hats have a manufacture date of April 2016, May 2016, December 2017 or January 2018. Consumers should immediately stop using the recalled hard hats and contact Honeywell to receive a product credit or voucher equal to the purchase price of the recalled hard hat.

June OSHA Focus Four: Caught-In or -Between
|
|
The Focus Four Hazards have accounted for the vast majority of injuries and fatalities in the construction industry. In an effort to prevent future injuries and fatalities, OSHA, our state plans, consultation projects, and construction industry partners have initiated a “Focus Four Hazards” campaign from March through June in Region Three’s jurisdiction.
The goal of this campaign is to raise awareness in the recognition, evaluation, and control of these hazards through the delivery of toolbox talks for employers to provide to their workers. The month of June focuses on Caught In/Between Hazards. Using the link below, you'll find handouts, guides, and activities for your employees that will help them reduce the occurrence of these hazards.
