Dear Readers:

As the summer draws to a close, the immigration arena in the US is continuing to heat-up. Recent issues such as the "travel ban", "sanctuary cities", DACA elimination and increased visa scrutiny persist. We can only hope that the silver-lining is that immigration issues will continue to receive the attention they deserve.

Of course, as we enter the new school year, NPZ phones are ringing with frustrations by potential international students whose cases have been held at US consulate offices abroad caught in the "administrative process. Also, in the name of "extreme vetting" the USCIS announced that ALL employment-based immigration cases are being interviewed. A look into the "crystal ball" tells us that new "vetting" initiatives will result in severe delays in the academic and business immigration arenas.

NPZ Law Group's immigration lawyers and attorneys continue to do their best to assist clients and potential clients to understand the nuances in the US immigration law system and to find new methodologies to help circumvent persistent delays. We are given to understand that USCIS has been denying Form I-131 advance parole applications for abandonment in instances where the applicant has traveled abroad during the pendency of the application. The pending Form I-131 application is being denied even if the applicant has a separate valid advance parole document or a valid H, K, L, or V visa to return to the United States. In the denial notification, USCIS points to the Form I-131 instructions at page 6 where it states that "[i]f you depart the United States before the Advance Parole Document is issued, your application for an Advance Parole Document will be considered abandoned." In the past, USCIS has approved advance parole renewal applications for individuals who travel abroad during the pendancy of the application with a valid Advance Parole Document or a valid H, K, L, or V visa.

U.S. Citizenship and Immigration Services (USCIS) will begin expanding in-person interviews for certain immigration benefit applicants whose benefit, if granted, would allow them to permanently reside in the United States. 

This change complies with Executive Order 13780, "Protecting the Nation From Foreign Terrorist Entry Into the United States," and is part of the agency's comprehensive strategy to further improve the detection and prevention of fraud and further enhance the integrity of the immigration system.
Effective Oct. 1, USCIS will begin to phase-in interviews for the following:
  • Adjustment of status applications based on employment (Form I-485, Application to Register Permanent Residence or Adjust Status). 
  • Refugee/asylee relative petitions (Form I-730, Refugee/Asylee Relative Petition) for beneficiaries who are in the United States and are petitioning to join a principal asylee/refugee applicant.

THE FUTURE OF THE 'DREAMERS' MAY BE AT STAKE.
What is the DACA Program?

The Obama administration introduced the Deferred Action for Childhood Arrivals (DACA) program in 2012.  The program allows qualifying undocumented immigrants who entered the United States as minors to be protected against deportation, and have the ability to obtain a work permit. Participants could use this time to become U.S. citizens.  Program participants are often referred to as "Dreamers."  With a lawsuit looming, however, the DACA program could soon be eliminated if the Trump administration does not step in to support it. 

THE P-1A VISA: ALLOWING TALENTED ATHLETES TO COME TO THE U.S.  
What are the requirements for obtaining a P-1A visa?

If you are an athlete who has been hired by an American sports league or team, you may be able to obtain a P-1A visa that will allow you to immigrate to the U.S.  The P-1A visa is available only to select athletes.  For athletes meeting the requirements of the P-1A visa, this type of visa may provide your answer to gaining the right to live and work in the U.S.  Our immigration lawyers at NPZ Law Group discuss the P-1A visa and what you need to know before applying.


USCIS ALERTS THOSE AFFECTED BY HURRICANE HARVEY TO AVAILABLE IMMIGRATION SERVICES. 
USCIS offers immigration services that may help people affected by unforeseen circumstances, including disasters such as Hurricane Harvey.
 
The following measures may be available on a case-by-case basis upon request:  
  • Changing a nonimmigrant status or extending a nonimmigrant stay for an individual currently in the United States. Failure to apply for the extension or change before expiration of your authorized period of admission may be excused if the delay was due to extraordinary circumstances beyond your control;
  • Re-parole of individuals previously granted parole by USCIS;
  • Expedited processing of advance parole requests;
  • Expedited adjudication of requests for off-campus employment authorization for F-1 students experiencing severe economic hardship;
PRESIDENT TRUMP BACKS RAISE ACT . 
On 8/2/17, Senators Tom Cotton (R-AR) and David Perdue (R-GA) introduced the Reforming American Immigration for a Strong Economy (RAISE) Act, which would create a skills-based immigration points system, end the Diversity Visa Program, and reduce the number of family-based immigrants and refugees. The legislation would award points based on education, ability to speak English, high-paying job offers, age, record of achievement and entrepreneurial initiative. President Donald J. Trump supported the Reforming American Immigration for a Strong Economy (RAISE) Act to prioritize immigrants based on the skills they bring to our Nation while safeguarding the jobs of American workers.

DOS VISA BULLETIN UPDATE: VISA BULLETIN FOR SEPTEMBER 2017 - IF YOUR "PRIORITY DATE" IS CURRENT PLEASE LET US KNOW?  
The Visa Bulletin for September 2017, which is the last visa bulletin of fiscal year 2017, was released by the U.S. Department of State (DOS) this morning. There was no movement in the dates for filing chart, and only a bit of progress in the final action (FA) chart.
 
The employment-based, second preference (EB2) cutoff date for India moves ahead by one month, to August 22nd, 2008. This is a bit surprising, in that DOS predicted no forward movement for EB2 India this month, and actually was concerned it may retrogress. EB2 China edges ahead by three weeks, to a May 15th, 2013, cutoff date.

In the employment-based, third preference (EB3) category, India's cutoff date advances by three months, to October 15th, 2006. EB3 China, on the other hand, holds steady at January 1st, 2012.

O Serviço de Cidadania e Imigração dos Estados Unidos (USCIS) está emitindo uma orientação política no "Manual de Políticas do USCIS" para abordar as políticas e procedimentos gerais aplicáveis à adjudicação de isenções de inadmissibilidade.

Geralmente, estrangeiros não são autorizados a entrar nos EUA ou a obter certos benefícios de imigração se eles forem considerados inadmissíveis.

FALL SEASON IMMIGRATION UPDATE UNDER THE TRUMP ADMINISTRATION. 
 
 
 
President Donald Trump announced his support Wednesday for legislation that would cut in half the number of legal immigrants allowed into the United States while moving to a "merit-based" system of entry.

"That is why we are here today: Merit-based," said Trump, who was joined in the White House Roosevelt Room by the bill's Senate sponsors, Tom Cotton, R-Ark., and David Perdue, R-Ga.
The RAISE Act, which Cotton and Perdue introduced in February, would scrap the current lottery system to get into the U.S. and instead institute a points-based system for earning a green card.

Factors that would be taken into account include English language skills, education, high-paying job offers and age. The number of legal immigrants would be reduced by 50 percent over 10 years.
