What a great year it has been thus far! We are more than half way through the year and we have already accomplished so much, yet we have so many great things to look forward to.
At the end of last month we had our 3rd Annual Crafts & Cars event at Cadence Park with almost 300 attendees. What a great time! The food and brews were delicious and we had some amazing cars in our classic car and motorcycle show. Congratulations to our 1st Place Winner, Ken Ryan of KTGY Group.
Your VW Camper Bus is truly one of a kind. I want to give a big thank you to all of our sponsors. Without your sponsorships and participation this event would not have been possible, so thank you once again.
Last week we also had our BIAOC & BIARV Meet The Builder event. This is always a great networking event for the builders, developers, and trades.
Next month is a busy month for us. We have two big events in the same week! Although our Baseball night at Angel Stadium on Tuesday, August 7th is SOLD OUT, we are still selling all you can eat Taco Tailgate tickets for
just $25 for anyone who wants to join and purchase their own tickets to the game. C'mon out and join us!!!
Our Mid-Year Economic Update: The Bull vs The Bear on Thursday, August 9th is getting close to capacity, so do not wait to register. Not only will this be an epic "battle" between Meyers (The Bull) and Metrostudy (The Bear), but we also have Johnathan Lansner from the Orange County Register as our Moderator. There will also be a Member Recognition for long-standing BIA Members and a Contributor of the Year, for the company who has given the most to HomeAid OC. Don't be left out of the loop and register today!
We also have our Softball Tournament coming up on Friday, September 14th and the team spots are almost all filled! If you are interested in playing this year I would sign up as soon as possible to ensure that you have a spot in the tournament. I played last year and I had a blast. I am so glad this event is back and stronger than ever!

Tustin Inclusionary Zoning
After nearly six-months of negotiations, Tustin staff used the cover of the 4th of July holiday to propose new unvetted policy language. BIA/OC was there to continue the fight against inclusionary zoning and was shocked by the brazen effort to push new language that undermined months of hard work and burgeoning collaboration. Furthermore, Tustin did not publicly announce or disclose the policy they approved July 3rd in advance of the hearing. Comments shared from the dais implied that the policy had been worked on in advance. BIA/OC is excited to partner with BILD to continue the work in Tustin to protect home creation.
As to the policy in question, Tustin has tentatively approved an approach that will require both on-site construction and an in-lieu fee. Either 5% Very Low Income or 10% Low Income needs to be build concurrent with any development within a Specific Plan and then 50% of total units in the development will be assessed a $12,000 per door in-lieu fee. Part of the approach proffered by Tustin included a provision that the on-site requirements could be constructed off-site but details on how that would be put into practice are yet to be shared.
The City has scheduled the next hearing on this matter for Saturday, August 11th at 8AM. As Council meetings are typically 7pm on Tuesday nights, a Saturday morning meeting is an odd approach if the desire is to properly have the matter presented to the public.
City of Anaheim
BIA/OC is happy to report good news out of Anaheim. The City Council has rejected Inclusionary Zoning (IZ) and is working with Industry to address concerns over Development Impact Fees.
In rejecting IZ, the Council approved exciting, incentive-based approaches to addressing the region's affordability crisis. Specifically, staff is proposing a concierge approach to working with developers that will empower staff to offer incentives, streamlining and voluntary inducements that will allow developers to make affordable opportunities pencil.
On the matter of Development Impact Fees, the city has suggested an approach that may include grandfathering some projects, phasing implementation and reducing proposed increases. There is certainly cause for optimism as this proposal is prepared. A vote is expected in August.
City of Newport Beach
The City of Newport Beach is considering an overhaul of their fire/life-safety fee structure. Under the current structure, a 500 unit multi-family complex would pay a $580 inspection fee and a $528 Plan Review. Under the change, a base fee of $333 would be charged on the inspection fee and then an additional charge of $9 per unit. This would push a 500 unit complex to a fee of $4,833. For the Plan Review, the fee would jump to $4,232.
Council received comments from BIA/OC on this proposed change at a Study Session hearing on July 10th. The result of this has been a revised staff recommendation calling for a phased implementation on the fee adjustments and BIA/OC will continue to work with staff as this proceeds.
County of Orange
BIA/OC continues to advocate for housing at the County of Orange. Currently under consideration is the Orange to Green zoning update. Two major issues arose under the proposed update that continues to demand BIA/OC's attention.
First, BIA/OC has consistently advocated against the proposed Tree Preservation Ordinance. As currently drafted, multiple species of trees will receive protections that require significant mitigation efforts for anyone looking to do work on County land. BIA/OC has submitted comments at multiple hearings and has seen progress towards reduction in scope of the policy. A final version has not yet been drafted and BIA/OC remain vigilant.
Next, the Orange to Green will be amending parking standards on County land. This has been heavily reviewed by BIA and the Development Processing Review Committee but at the last hearing on the matter, a requirement for all parking to be located within 200ft of a residence was presented. Applying this standard to multi-family housing could be devastating to a project so BIA/OC is currently in talks with staff to clarify these provisions and ensure parking standards to not stand in the way of housing opportunity.
City of Santa Ana
Although in the early stages, Santa Ana is considering alterations to its Housing Opportunity Ordinance, also known as Inclusionary Zoning Ordinance. BIA/OC will closely monitor developments as this story unfolds.
July Government Affairs Committee
The July Government Affairs Committee meeting took on a new approach. With a new format, location and partnership with the Urban Infill Committee, the July joint meeting brought three dynamic City Council candidates in to speak.
Up first was Carrie O'Malley who is running for City Council in the City of Irvine. Next, we heard from Mitch Caldwell, running for District #3 in the City of Anaheim. Finally, we heard from Austin Lumbard, candidate for the Tustin City Council. Each speaker shared their commitment to their hometowns and their plans for the future. With housing at a crisis level county and statewide, much of the conversation focused on housing solutions.
We were excited to hear the approach each plans to bring and look forward to hosting similar such events in the future. The fate of Orange County's housing hangs on the November election and meeting with the candidates hoping to define our future is critically important for all in the homebuilding industry.
