Per Austin City Code, city departments may adopt Rules to support the administration of the Land Development Code. Rules are contained in the
City of Austin's Technical Criteria Manuals.

We would like to inform you that the Development Services Department (DSD) has posted notices regarding three proposed land development Rules with the Office of the City Clerk. Included below are summaries of each of the proposed rules and links to the notices posted with the  Office of the City Clerk .

We welcome your review and feedback. The comment period is open through February 23rd or 24th, respectively. Please forward all questions and/or comments to David.Gonzalez@austintexas.gov . Comments on the posted rules must be received prior to the end of the comment period.

Sections 1.4.2, 1.4.3, 1.4.4, and 1.4.5 of the ECM are being revised to align with the Land Development Code and inspections procedures for residential construction projects. In addition, State requirements for stormwater control are being clarified as to when they apply and what the requirements are for construction sites with disturbance of one acre or larger.

Standard details 628S Triangular Sediment Filter Dike, 642S-1 Silt Fence
and 648S-1 Mulch Sock are being revised to match the corresponding requirements outlined in the Standard Specifications Manual.

Recently enacted state law (House Bill 3167) establishes new review timelines and creates limitations on providing comments for subdivision applications authorized under Texas Local Government Code Chapter 212. House Bill 3167 was effective on September 1, 2019. On August 23, 2019, Council adopted Ordinance Number 20190822-117 on an emergency basis, amending Title 25 and Title 30 of the Land Development Code as necessary to comply with the directives in House Bill 3167. This rule was previously an emergency rule, Rule No. R161-19.25e. Emergency rules were necessary to administer, review, and comply with Ordinance Number 20190823-I17. This permanent rule is necessary in order to streamline subdivision applications and ensure that the City is able to comply with the changes to state law. Changes made in this rule pertain to the Building Criteria Manual (BCM).
