WV Symphony League Holiday Tea Party

Bailey & Wyant, PLLC Attorneys Secure Summary Judgment on Behalf of
WV Division of Corrections
Bailey & Wyant, PLLC Equity Member, John Fuller, and Associate, Adam Strider, secured summary judgment on behalf of the West Virginia Division of Corrections against claims by the estate of Russell Hager following a fatal assault by another inmate.
The representative of Mr. Hager's estate claimed that Division of Corrections personnel acted negligently in supervising the inmate who attacked Mr. Hager, and that this negligence permitted him to obtain the weapon he used in the attack. Mr. Fuller and Mr. Strider successfully argued that qualified immunity barred the Plaintiff's claims, and that a federal cause of action under the Eighth Amendment was inapplicable.
The matter is of record under Robin Hager-Wolfe v. West Virginia Division of Corrections, et al., Kanawha County Civil Action 17-C-1131.

On December 19, we celebrated the hard work of our staff at Bailey & Wyant, PLLC with a create-your-own pasta bar with salad and bread sticks
from Olive Garden. Everyone gathered round the table and enjoyed a meal together before going home to spend time with their families. A merry time was had by all!

Member Presents to
WV Prosecuting
Attorney's Institute
On December 5, Member, Jim Marshall, gave a presentation to the West Virginia Prosecuting Attorney's Institute regarding the immunities afforded to prosecutors while carrying out their duties to attend to the criminal business of the state.
The presentation included an analysis of the development of the law regarding absolute prosecutorial immunity and qualified immunity in the United States Supreme Court of Appeals decisions since the seminal holding in Imbler v. Pachtman
, 424 U.S. 409 (1976).
The presentation also addressed the application of prosecutorial immunities in the Supreme Court of Appeals of State of West Virginia and pursuant to the West Virginia Governmental Tort Claims and Insurance Reform Act.

A Merry Celebration at Berry Hills Country Club
'Tis the season to eat, drink and be merry! Our attorneys had a wonderful time during their holiday party at Berry Hills Country Club on December 7. We celebrated Chuck Mozingo's retirement from WV BRIM and enjoyed the company of family and friends.

Michael W. Taylor is a Member of Bailey & Wyant, PLLC's Charleston office. He is originally from Clarksburg, West Virginia and is a graduate of West Virginia University College of Law, where he graduated Order of the Coif. He first stepped into our office the summer of 2010 as a Summer Clerk and joined the team officially in August of 2011 as an Associate.
Over the years, Taylor has proven himself as an excellent attorney with his defense litigation involving such issues as constitutional law, civil rights and Title IX violations, education law, employment discrimination, government liability and appellate advocacy. He has become a contributing member in the legal community by presenting at a multitude of events on behalf of the firm on topics of Title IX, Bullying in the Workplace, and Social Media Policies and Procedures, to name a few. Taylor is a published author, having his article on the fiduciary obligations of online service providers to its users published in the West Virginia Law Review.
