"Short and Sweet Legislative Session Update"

Of all the bills filed regarding community associations from this 2018 Florida legislative session, only two major bills had survived by the end of the session on Friday, March 9:   HB 841, which is this year's "omnibus" bill, and HB 617, which relates to MRTA (the Florida Marketable Record Title Act).  As of the date of writing this blog, the bills were on the way to the Governor for signature, or potentially for veto. As such, it is important to note that as of the date of writing this blog, these bills have NOT been fully approved and are NOT yet law. Stay tuned! If the bills do become law, expect a more detailed update in the weeks and months to come.

Need A Space To Have Your Meeting?
 
We bet you have not been taking advantage of a very special service we offer at our Melbourne Office.  Would you like to host a board or membership meeting somewhere else because:
 
  • You would prefer a low key meeting without distractions;
  • Would like an attorney present for all or part of the meeting;
  • You need a professional setting.
 
Well, we have just the solution for you.  Our large Melbourne conference room located off Wickham Road in the Viera/Suntree area can host up to fifteen people in a professional setting with a screen and projector made available to our clients.  There is plenty of complimentary lighted parking available.  While there is no charge to use the room, there would be a fee for the time that the attorney would be present in the meeting.  When their presence isn't needed, they will retire to another part of the office to work on other matters and you can always call them back in the room if the need arises.
 
This service is especially valuable to our clients if there are sensitive subjects to discuss.  While you can't bar your residents from attending most Association meetings, based on our experience it is rare for residents to attend a meeting at one of our offices.

The March 2018 Official State Approved Board Certification Class 
 
Did you know that the Florida Legislature passed legislation a few years ago requiring every Board Member to take this class o r execute an Affidavit stating that you have read, understand your Documents, the ramifications of non-compliance, and agree to enforce your Documents? If you went off the Board for even a day, you must re-take the class.    Make sure you attend this year's Certification Class to get the scoop on what is expected of you as a Board Member.     

You asked for it - and we are granting your wish.  We feature separate classes for HOAs, Condos/Co-ops, and Mobile Home Parks.  We have updated this course to comply with the yearly changes to the law.  Join us for two hours of preparing you for your role on the Board.

Who's The Most Awesome In Your Association?
As we bring the first quarter nomination period to a close we are again astounded by how many amazing Community Association Board Members and Managers there are in Central Florida. No submitted nominee makes our quarterly decision of who is most deserving easy.  If you know someone (Manager or Board Member) in your community that is truly amazing, be sure to nominate them! Second Quarter Most Awesome Nominations are due April 20, 2018.

 New Community Association Organizations Forming
 
There are several new organizations for members of HOAs, Condos, Co-Ops, and Mobile Home Parks starting their corporate organizational planning in three different areas of Central Florida in the coming months.  They are:
  Brevard County
Cities of Ocoee-Winter Garden-Gotha-Windermere
Cities of New Smyrna Beach-Oak Hill-Edgewater-Scottsmoor-Mims
 
These non-profit groups are in the early stages of organizational meetings.  If you currently serve on a Board of Directors for a Community Association, you are eligible for membership.  Want more information? Did You Know? 
 
Clayton & McCulloh has a new complimentary registered agent  service. Make your life easier by having us serve as your registered agent .  This is the time of the year where you  provide your Board of Director information to the State for your corporate report.  At that time, you should designate a registered agent who is available from 9:00 a.m. to 5:00 p.m. weekdays to accept service for the Association.  And you can designate Clayton & McCulloh as your registered agent at no additional filing fee when you file your Association's 2018 report. If you have already filed your 2018 Association report a small 3rd party filing fee would be required to update Clayton & McCulloh as your registered agent.

Serving as a registered agent can be an intrusion on your personal life by having process servers knocking at your door or having to go to the Post Office to sign for a certified letter.  Perhaps the person you designated as your registered agent is not available during the designated hours because they work (or because they have a life).  Having a Board Member serve as your Association's registered agent may also add risk to the Association if the recipient does not handle the item served upon the Association timely and properly.  We will not take any legal actions on any papers that are served upon us without your prior approval.
