Dear Readers:

As we went to press the U.S. Supreme Court agreed to hear the Travel Ban case . . . but not until the Fall. However, in the interim, a Travel Ban will take effect that is limited in its scope. Checkout the Supreme Court's decision below. It looks like we are in for an extremely interesting summer!

Last week, several NPZ Law Group attorneys attended the American Immigration Lawyers Association (AILA) National 2017 Conference in New Orleans. The Conference was an opportunity for our staff to meet government officials from the DOL, USCIS, EOIR, DOS, etc., and to discuss various burgeoning U.S. immigration issues and to collaborate with our counterparts from throughout the U.S. about visa processing strategies and protocols. The big news that was shared at the Conference was that since the Trump Administration announced a crackdown on undocumented immigrants, stories of individuals abruptly deported seems to be the new norm. In an effort to cast a wider net, the Trump Administration has made it a priority to deport people who have lived in the U.S. for decades. The Department of Homeland Security (DHS) has done away with the previous priorities program (PEP) and has expanded its sweep to include anyone who does not have status.
 
Attorney General, Jeff Sessions, stated that: "Everybody in the country illegally is subject to being deported, so people come here and they stay here a few years and somehow they think they are not subject to being deported" well, they are". DHS Secretary John F. Kelly echoed these sentiments, stating: "ICE will no longer exempt classes or categories of removable [immigrants] from potential enforcement". Arrests of noncriminal foreign nationals under the current Administration have doubled and it appears that roughly half of the arrests were of people with no criminal convictions or were guilty of a mere traffic ticket. As a result, immigration-related arrests have increased by nearly 40 percent since this time last year. 
 
Another important and burgeoning development announced by ICE is that a new I-9 Form will be promulgated on July 18th, 2017. The new I-9 Form will be used in September. Additionally, the new Parole Rule for Entrepreneurs has been sent back to the OMB. The future viability of the Entrepreneurial Parole Rule is unknown at this time. Another important Business Immigration announcement made at the Conference is that DOL will be preparing a new LCA (ETA 9035 Form) since the present Form is due to expire in the Spring, 2018.

In general, it appears that DOL, DHS and DOS will be working together to aggressively combat fraud in the business immigration arena. LET'S TRY IT AGAIN: SUPREME COURT MAKES WAY FOR A LIMITED TRUMP TRAVEL BAN TO GO INTO EFFECT TONIGHT.   
The Supreme Court has decided to hear the Travel Ban case when its fall session begins in October, 2017. In the meantime, the Court will allow the Administration to implement parts of President Trump's Second Executive Order (EO-2), which bans the entry of nationals of Iran, Libya, Somalia, Sudan, Syria and Yemen from the United States for at least 90 days and suspends the admission of all refugees for 120 days.
 
In a narrow decision, the Court ruled that the government can only enforce the travel ban against foreign nationals who do not have "a credible claim of a bona fide relationship with a person or entity in the United States." This summer we will be grappling with the definition of what a "bona fide relationship" is . . .  
 
P-3 VISAS FOR ARTISTS AND ENTERTAINERS: EXPLORING THE P-3 VISA FOR ARTISTS OR ENTERTAINERS IN A CULTURALLY UNIQUE PROGRAM.    
Am I eligible to receive a P-3 visa?
 
For certain artists or entertainers, the P-3 temporary worker visa may allow you to engage in work on a culturally unique program within the United States.  The P-3 visa may assist those that are looking to enter the U.S. to teach, perform, or coach as an entertainer or artist under a program that is deemed culturally unique.  There are several benefits to this visa type for eligible immigrants.  Our experienced immigration lawyers at NPZ Law Group offer an overview of the P-3 visa and its eligibility requirements below.
 
To receive a P-3 visa, you must demonstrate that you are coming to the U.S., either on your own or as part of a group, for the purpose of interpreting, developing, coaching, teaching, or representing a traditional or unique ethnic, theatrical, artistic, cultural, musical, or folk performance or presentation.

J-1 TRAINING PROGRAMS: PROMOTING CULTURAL EXCHANGE WITH A J-1 VISA.    
How do I apply for a J-1, Exchange Visitor nonimmigrant visa?
 
A J-1 visa is a type of non-immigrant visa granted by the United States to eligible professors, students, entrepreneurs, and others who will participate in programs that promote cultural exchange.  The J-1 visa Exchange Visitor Program (EVP) brings an estimated 300,000 foreign visitors from more than 200 countries and territories to the U.S. each year.  Those seeking to enter the U.S. on a short-term basis to study, teach, research, and the like should investigate the J-1 visa to determine if it is right for them.

PREMIUM PROCESSING UPDATE: USCIS TO RESUME H-1B PREMIUM PROCESSING FOR PHYSICIANS UNDER THE CONRAD 30 WAIVER PROGRAM.     
On June 23rd, U.S. Citizenship and Immigration Services announced that starting from June 26th, the Agency will resume premium processing for all H-1B petitions filed for medical doctors under the Conrad 30 Waiver program, as well as interested government agency waivers. The Conrad 30 program allows certain medical doctors to stay in the United States on a temporary visa after completing their medical training to work in rural and urban areas that have shortage of physicians.
 
"This program improves health care access for Americans living in underserved areas, and we are pleased to resume premium processing for these petitions," said USCIS Acting Director James McCament.                                                        
Starting June 26th, eligible petitioners for medical doctors seeking H-1B status under the Conrad 30 program, or through an interested government agency waiver, can file Form I-907, Request for Premium Processing Service for Form I-129, Petition for a Nonimmigrant Worker. Form I-907 can be filed together with an H-1B petition or separately for a pending H-1B petition. 
 
Why do I need an attorney if I am facing deportation?
 
Every criminal defendant is entitled to legal representation and will be appointed a lawyer if they cannot afford to hire one.  However, unlike in criminal proceedings, immigrants facing deportation have no right to an attorney.  Immigrant detainees have the right to hire a lawyer, but if they cannot afford one, they will be left defending against serious charges without legal counsel.  Immigrants that may be deported face losing their homes, families, and lives within the United States.  Alone and without experience or training to defend against deportation, most unrepresented immigrants will lose the fight to stay within the country. 
 
Recognizing the tremendous obstacles faced by immigrants in deportation proceedings, a group of advocates in New York City has taken action to ensure all immigrants receive legal assistance.  The New York Immigrant Family Unity Project was born in 2011 and comprises the nation's first public defender system for immigrants.  Since its inception, the NYIFUP has provided a lawyer to every immigrant who is detained and facing deportation within the city when they cannot afford one. 
 
VISA WAIVER PROGRAM UPDATES: CBP FAQS ON THE VISA WAIVER PROGRAM IMPROVEMENT AND TERRORIST TRAVEL PREVENTION ACT.   
CBP provides FAQs on changes to the Visa Waiver Program and ESTA due to the Visa Waiver Program Improvement and Terrorist Travel Prevention Act of 2015. The FAQ was updated to include information regarding the question added in October 2016 regarding social media profiles. 
 
USCIS FORM UPDATE: USCIS INTRODUCES A NEW I-485 FORM.   
U.S. Citizenship and Immigration Services today published a revised Application to Register Permanent Residence or Adjust Status (Form I-485).

The new Form I-485 and instructions have been substantially updated to reduce complexity after collecting comments from the public and from stakeholders.
 
 
DOS VISA BULLETIN UPDATE: VISA BULLETIN FOR JULY 2017 - IF YOUR "PRIORITY DATE" IS CURRENT PLEASE LET US KNOW?  
EB-1 China and India. The final action date for EB-1 China and EB-1 India (January 1, 2012) that was imposed in June 2017 remains for July 2017 and is expected to hold through the end of this fiscal year. Due to the availability (through May) of "otherwise unused numbers" in these categories, EB-1 China has used more than 6,300 numbers and EB-1 India has used more than 12,900 so far this fiscal year.

EB-2 Worldwide. Since demand declined slightly in the second half of May, and demand during the first week of June was steady, DOS felt comfortable keeping EB-2 Worldwide current in July. A final action cut-off date will be imposed in this category in August and will be more dramatic than it would have been if a date had been imposed in July. The good news is that this category will become current again on October 1, 2017.

 

CANADA IMMIGRATION UPDATES FROM NPZ'S CLG.

On June 8th, 2017, our Canadian Law Group's managing lawyer, Veronique Malka, a member of the Executive of the Canadian Bar Association, spoke to an audience of immigration lawyers in Toronto, at the Ontario Bar Association.  The Topic was the hot button issue of navigating the U.S. - Canada border in the era of Trump and Trudeau.  She was joined by a panel of seasoned cross-border immigration experts on the subject.  The discussion concerned key issues such as the future of the North American Free Trade Agreement, what is actually happening at the U.S. and Canadian borders, President Trump's executive orders, and upcoming other immigration legal changes in the United States.
NAFTA, A VIEW FROM THE NORTH - Will NAFTA BE TRUMPED? By Veronique Malka
canadian_flag_waving.jpg Canadian and U.S. immigration lawyers have been concerned about the future of the NAFTA, a treaty which has been serving as a useful vehicle to facilitate the cross-border admission of foreign workers in North America since 1994. Throughout his campaign for the Presidency of the U.S.A, President Trump announced that he would be withdrawing from the NAFTA, the North American Fair Trade Agreement, an agreement signed by Mexico, the United States, and Canada, allowing for more open commercial trade between the three countries. It became into force in 1994. Trump's reasoning for withdrawing from NAFTA is that the agreement's downfalls outweigh its benefits to the United States. However, his decision to Trump NAFTA encompasses many obstacles which will need to be overcome in order to move forward with this plan.

EXTREME VETTING: CHANGES TO THE VETTING PROCESS PROPOSED BY PRESIDENT TRUMP.  
 
 
Donald Trump's speech on the threat of radical Islam included a section about immigration policy that has the usual suspects in a tizzy. This section focused not on terrorism, but rather on what Andy McCarthy calls the "grand jihad," the importation of Islamist ideology that rejects our constitutional order and open society.

In his trademark manner, Trump departed from the prepared text to Archie Bunker-ize the speech by calling this "extreme vetting," which is not the phraseology you should use once you've won the nomination and are trying to persuade the middle-of-the-road voter in Ohio and Florida. But rather than calling for body-cavity searches, as this label might suggest, he was instead calling for ideological/values screening, with the commonsense goal that "we should only admit into this country those who share our values and respect our people."
