John Jensen performs Ives, Ruggles, Copland,
Macy, and Yramategui
John Jensen, pianist, will present a piano recital of American music at
Hidden Valley Music Seminars on Monday, September 24, at 7:30 PM.
Admission is $20.
Jensen will perform Charles Ives' Sonata #1 , Aaron Copland's Piano
Sonata, and Carl Ruggles' Evocations. Two additional works will feature
local composers and performers: Rick Yramategui's Theme and
Variations with guest violinst, Farkhard Khudyev, and the premiere of
"2" for piano 4-hands by Carleton Macy, with Yramategui joining Jensen
at the piano.

Monterey County Launches 24/7
Complaint Hotline for Short-Term Rentals
The Resource Management Agency of Monterey County announced that it has launched a 24/7 hotline to collect complaints related to public nuisances resulting from short-term rental activity in the unincorporated areas of Monterey County.
"We launched the complaint hotline to better understand the community's nuisance concerns about short-term rentals," said Chief Building Official Neville Pereira. "As we work to develop a better policy solution to this important issue, we want to be in touch with the community on all sides."
"Our policy must be enforceable," added Pereira. "The hotline gives us a way of taking code enforcement into consideration and gives the community a chance to be heard."

Park It! Project Moves Forward

As most of you know, Monterey-Salinas Transit has submitted a grant application to the Monterey Bay Air Resources District for the Park It! Point Lobos Area Shuttle. The shuttle service is a key element of the summer 2019 Demonstration Project. Other elements of the project include offsite parking north of the Carmel River, a reservation system, and elimination of Highway parking in the vicinity of Point Lobos. We are thankful that MST is leading the effort to provide shuttle service during the demonstration.

Rio Ranch Commercial Development
Draft EIR Published
From the DEIR:
Foothill Partners is proposing to build a commercial retail development on approximately 3.8 acres of land located at 3705 Rio Road within the County of Monterey's Carmel Valley Master Plan Area in unincorporated Monterey County, California. The retail development would consist of four commercial retail buildings, including a maximum 23,000 square foot convenience market/grocery store and three smaller buildings ranging from approximately 5,000 to 8,335 square feet. The development would additionally include two commercial retail farm sheds of 250 square foot each. In total, the project would involve the construction of 42,310 square feet of commercial space, and the building footprint of all buildings would occupy 26 percent of the 164,421-square foot site.

Cima Collina Winery Sues the County
Over Denial of Special Events at Hilltop Ranch
In late 2017 the Monterey County Board of Supervisors re-affirmed the Planning Commission's reversal of the "administrator's interpretation" that Cima Collina's "Hilltop Ranch" be allowed to hold special events because some grapes are grown on the property. The board's decision was that special events and large marketing events are not part of viticulture in the low density residential zone. That was the position strongly advocated by CVA and the neighbors.
In January 2018 Hilltop Ranch sued the county, claiming that opponents (including CVA) waited too long to contest the administrator's interpretation and that neither the county supervisors nor the county planning commissioners had jurisdiction to hear the matter. Hilltop Ranch withdrew its petition (its initial legal pleading) after the county objected. Hilltop Ranch then filed an amended petition. The county again objected.
On July 11, the Superior Court heard oral arguments on the county's demurrer and motion to strike Hilltop Ranch's amended petition. The court sustained the county's demurrer with leave to amend. This means Hilltop Ranch got another opportunity to attempt to frame its legal claims in a new amended document.
In August, Hilltop Ranch filed a third version of its initial pleading with the court. In it Hilltop Ranch again argues that the county planning director's "interpretation" became final for all purposes ten days after it was issued - even though the planning director gave it only to Hilltop Ranch, and not to anybody else.
Representatives for CVA and the neighbors have attended the court hearings and they continue to monitor the situation.
Reversal of the County Supervisors' ruling, and the precedent set by it, would have an extremely negative impact on our valley!

September Ranch
 Clear Peak Group has purchased previously approved development rights for September Ranch. The Group's purchase comes with a tentative map and well permit, as well as 190 conditions for the 891-acre property. Planned is a Tehama style project with 73 residential lots, sized at 2-4 acres and priced at $1-1.5 million. The project also calls for 22 affordable housing units (15 inclusionary and 7 deed-restricted workforce housing). The equestrian center fronting Carmel Valley Road will remain in place.
The partners anticipate obtaining a final map and starting construction by April-June 2019. Phase 1 will develop primarily the east ridge of the property. The new entrance to the project will be toward the east side of the property, across from Brookdale Drive. As approved in 2011, conditions for that intersection specify a signal light.
More in keeping with current road policy, CVA is asking for a roundabout, not a signal light, on Carmel Valley Road at the new entrance. In that regard, we are pressing for that option with the County and with our Supervisor's office.

Rancho Cañada Court Case
Decided in CVA's Favor
On April 24, 2018, the court issued its statement of decision in Petitioner Carmel Valley Association's favor. As a consequence of the court's decision, the County of Monterey must set aside its approvals of the subdivision, including the County's certification of the Environmental Impact Report (EIR).
The Carmel Valley Association prevailed on the California Environmental Quality Act (CEQA) and affordable housing.
The developer can appeal, restart the process with new documents, or abandon the project. We understand the the developer has begun work on a revised Environmental Impact Report.
