Under a   new rule  published by the U.S. Department of Homeland Security, several changes to the EB-5 Immigrant Investor Program will go into effect on Nov. 21, 2019.

What You Need to Know After November 21, 2019:

Increased minimum investments:
  • The minimum investment in a TEA (Targeted Employment Area or Rural Area) increases to $900,000 (from $500,000).
  • The standard minimum investment amount in a Non-TEA or Non-Rural Area increases to $1.8 million (from $1 million).

Targeted employment area (TEA) designations:
  • DHS (U.S. Department of Homeland Security) will now directly review and determine the designation of high-unemployment TEAs; they will no longer rely on TEA designations made by each State government.
  • Specially designated high-unemployment TEAs will now consist of a calculation of combined adjacent census tracts, which is more restrictive than the present TEA calculation. Therefore, most TEA locations today will not be TEA’s after November 21, 2019. This will result in most EB-5 Regional Center Projects requiring US$1.8 million as the EB-5 investment amount.

Global: Business Meeting - Australia & Japan - August 14, 2019
Edward Beshara , Managing Partner was a guest speaker on a panel titled "Doing Business with Australia and Japan". The event was organized by the Orlando Regional Realtor Association (ORRA) Global Real Estate Council of Orlando.

Edward is Past Founder and President of the Australian American Chamber of Commerce of Florida and currently, he is the Vice President.

More than 100 realtors attended the presentation with the objective to learn how to expand their real estate network and do business with Australia and Japan.
AREAA FAR Convention – August 20 to 22, 2019
Edward Beshara , Managing Partner sponsored and presented to the Asian Real Estate Association of America (AREAA) at the 2019 Florida Realtor Convention.
Edward had the opportunity to network with international realtors and gave a presentation on EB-5 and how the purchase of real estate can be the first step towards obtaining U.S. permanent residency as well as temporary residency.

FIRST PATHWAY PARTNERS , and there President, Mr.Bob Kraft, ( also President of IIUSA , Invest in the USA, the representative organization of the EB-5 industry ), invited Edward Beshara to their main office in Milwaukie, to take an active role in their their team conference to discuss and strategize on new innovations and initiatives for foreign national investors before and after the new EB-5 Regulations take effect on November 21, 2019.

The discussions resulted in a new road map and journey to reach effectively and efficiently the goals of foreign nationals to obtain U.S. Residency.

Round Table With Orange County Sheriff Mina - September 9, 2019
Edward Beshara attended a round table discussion with Orange County Sheriff Mina (of Middle Eastern Heritage). On Tuesday, September 10, 2019. The meeting was organized on behalf of AILA CFC and the OCBA Immigration Law Committee.

The event was a great success. We had an awesome discussion about the anti-sanctuary city law, U-visa certifications, and how to handle issues of the unlawful practice of law (UPL) by immigration consultants.

Re-Registration Period Open for Individuals with TPS under Syria’s Designation
USCIS announced that current beneficiaries of Temporary Protected Status (TPS) under Syria’s designation who want to maintain their status through March 31, 2021, must re-register between Sept. 23 and Nov. 22, 2019. 

The new fiscal year will begin October 1st and that means the visa numbers are about to reset.  There is some progress, albeit minor, for the employment-based categories in October.

H-1B LCA Can Be Filed Only on DOL FLAG System.
Effective October 1, 2019 DOL will remove the current "iCERT" LCA filing system and employers will be able to file the H-1B LCA applications only on the new FLAG system. Read the details HERE

USCIS issued policy guidance on “residence” requirements for acquiring citizenship - August 28, 2019
USCIS Released on August 28, 2019 Policy Guidance on "Residence" Requirements for Acquiring Citizenship. As of Oct. 29, 2019, parents who reside outside the U.S. must file Form N-600K to obtain U.S. citizenship for any child who did not acquire citizenship at birth or while residing in the United States.

Final Rule of Inadmissibility on Public Charge Grounds Officially Published in the Federal Register - August 14, 2019
U.S. Department of Homeland Security (DHS) announced a final rule  that clearly defines long-standing law to better ensure that aliens seeking to enter and remain in the United States — either temporarily or permanently — are self-sufficient and rely on their own capabilities and the resources of family members, sponsors, and private organizations rather than on public resources.

USCIS Will Adjust International Footprint to Seven Locations
U.S. Citizenship and Immigration Services (USCIS) announced plans to maintain operations at its international field offices in Beijing and Guangzhou, China; Nairobi, Kenya; and New Delhi, India. While retaining these seven international offices, USCIS plans to close the remaining thirteen international field offices and three district offices between now and August 2020.
