Important New Update on the National Overtime Rule
On November 22, 2016, U.S. Judge Amos Mazzant in Texas issued a preliminary injunction to temporarily block the U.S. Department of Labor (DOL) from implementing and enforcing its Final Overtime Rule nationally. The new overtime rule would have required employers to start paying overtime to workers earning salaries of less than $47,476 a year. As a result of the injunction, employers currently do not need to comply by the original December 1 effective date.
However, the Justice Department, on behalf of the Department of Labor, filed a notice of appeal on Thursday, December 1, in the U.S. District Court for the Eastern District of Texas to defend the Obama administration overtime rule.
As of right now, the future of the rule is extremely uncertain. Even if the Obama administration wins its appeal, the incoming Trump administration has already threatened to scrap the measure.
