Reopening of Businesses – Local Enforcement of Sector Rules
Under Executive Order 7PP , failure of businesses reopening in compliance with the relevant Sector Rules constitutes a public nuisance under Section 19a-13-B1 of the Regulations of Connecticut State Agencies.  

Local/District Health Director’s Authority to Enforce Sector Rules
Local or district health directors are authorized under EO 7PP to order the closure of “Public Health Facilities” until the facility has abated the public nuisance by coming into compliance with the Sector Rules . For purposes of this order, a “Public Health Facility” shall include hair salons, barbershops, beauty shops, nail salons, spas, tattoo or piercing establishments, restaurants, eating establishments, private clubs, or any locations licensed for on-premise consumption of alcohol, that are allowed to reopen pursuant to the Sector Rules, as amended from time to time. In addition to ordering the closure of such facilities, the local or district health director may issue citations or utilize other enforcement remedies available under existing law.

Municipal Chief Executive Officer’s Authority to Enforce Sector Rules
Municipal Chief Executive Officers (CEO) shall select a municipal employee or official to have authority over public nuisances arising from violations of the Sector Rules by any business or entity that is not considered a Public Health Facility under the order. Although a Municipal CEO shall not select a local health director, district health director, or the staff of a local or district health director as their Municipal Designee, the CEO may select themselves. Under the EO, the Municipal Designee may order the closure of any business other than a Public Health Facility in violation of the Sector Rules until such time as the Municipal Designee determines that the such business has abated the nuisance by coming into compliance with the Sector Rules. In addition to ordering the closure of such facilities, the Municipal Designee may issue citations or utilize other enforcement remedies available under existing law.
