NASW Takes Steps to Protect Women's Access to Birth Control

NASW has joined several other labor and advocacy organizations in filing an  amicus brief* in the lawsuit "Commonwealth of Pennsylvania and the State of New Jersey vs. Donald Trump."

The legal brief supports a lawsuit challenging the final contraceptive rules issued by the Trump administration on November 7, 2018, which allow for broad-based religious and moral objections to the coverage of contraceptives under the preventive services requirement of the Affordable Care Act (ACA).

The brief sets forth the argument that "invalidation of the final exemption rules is necessary to prevent harm to women in every state across the country" and counters that "seamless no-cost contraceptive coverage is essential to women's equality and advancement."

The brief concludes "if the Final Exemption Rules become enforceable, at least hundreds of thousands of women, and likely millions--including those represented by Amici--across the United States are at risk of being significantly harmed."

NASW-NJ will keep you informed as this issue proceeds through the courts.

* Latin for "friend of the  court." Frequently, a person or group who is not a  party to an  action, but has a strong interest in the matter, will  petition the  court for permission to submit a  brief in the  action with the intent of influencing the  court's  decision. Such briefs are called "amicus briefs."

ADVOCACY
Urge Congress to Fund and Protect the Older Americans Act and Other Aging Services Programs.

The Older Americans Act (OAA) and other federally funded aging services programs help older adults to maximize dignity, health, and independence. Services funded through the OAA include case management, elder abuse prevention, family caregiver supports, nutrition programs, and transportation. Social workers are involved in the provision and administration of many of these programs, which are a cost-effective way of enabling older adults to age in their homes and communities.

In partnership with the Leadership Council of Aging Organizations, the Eldercare Workforce Alliance, and other groups, NASW has advocated consistently to fund the OAA and other aging services programs. Thanks to this persistence, funding for some programs was increased or held steady in fiscal years (FYs) 2018 and 2019. However, funding for the OAA and other aging services programs falls far short of the need, and the President's budget proposal for FY 2020 will exacerbate the problem. Your help is needed to ensure Congress passes a budget that enables the OAA and other aging services programs--and, consequently, older adults and entire communities--to thrive.

Health care and social service workers are nearly five times more likely to be assaulted than other workers, and the rate of violent injuries is growing rapidly. The
Workplace Violence Prevention for Health Care and Social Service Workers Act  seeks to keep social workers, health care professionals, and social service professionals safe at work. This much-needed legislation would require hospitals, residential treatment facilities, substance use disorder treatment centers, clinics at correctional or detention facilities, and other service facilities to develop and implement comprehensive violence prevention plans and provide whistle-blower protections for workers.

Clinical social workers are one of three mental health professions that provide psychotherapy services for Medicare beneficiaries. Medicare reimburses clinical social workers at only 75% of the rate reimbursed to psychiatrists and psychologists. This rate is even lower than the 85% other non-physician practitioners (such as physical therapists, physician assistants, and occupational therapists) are reimbursed. This discrepancy deters clinical social workers from becoming Medicare providers and makes it difficult to retain clinical social workers as Medicare providers, thereby decreasing Medicare beneficiaries' access to mental health services. A key provision of the bipartisan legislation is to increase the reimbursement rate for clinical social workers to 85% of the physician fee schedule, which would ensure beneficiaries' access to clinical social workers.
