NOVEL CORONA VIRUS – COVID-19 UPDATE

The Association’s Executive Board met this past Saturday, March 14, 2020 to review the current business environment and the challenges businesses are facing and the impacts on you, our membership, your employees and your personal families. And, as you would expect the NOVEL CORONA VIRUS COVID-19 was discussed in great detail and concern.   

After the discussions, the following decisions were motioned, voted and approved by the Executive Board of our Association:

Join us for CCPA Updates and learn what dealers need to know to be and stay in compliance. The CCPA law went into effect on January 1, 2020 . Are you prepared?

What is the CCPA?
AB 375 allows any California consumer to demand to see all the information a company has saved on them, as well as a full list of all the third parties that data is shared with. In addition, the California law allows consumers to sue companies if the privacy guidelines are violated, even if there is no breach.

What does your company need to comply with the CCPA?
The law went into effect on January 1, 2020. As a practical matter, companies needed to have their data tracking systems in place by the start of 2019, since it gives consumers the right to request all the data a company has collected on them over the previous 12 months. That was a very tight time frame.

The California Supreme Court recently held in Frlekin v. Apple that employees’ time spent on the employer’s premises waiting for, and undergoing, required exit searches of packages, bags, or personal technology devices voluntarily brought to work by the employees purely for personal convenience is compensable as hours worked within the meaning of Industrial Welfare Commission wage order No. 7-2001, under the “control” test.

Ransomware attack hits car dealer
What should you do to prepare?

In December of 2019, a Florida car dealership was hit by a ransomware attack. This sophisticated style of data security attack breaks into a network and locks access to email, databases, and other essential files and programs. The hackers typically then demand a large payment in the form of an untraceable financial instrument. In this case the hackers demanded 65 Bitcoins, roughly equivalent to $600,000, to restore access to the dealership’s systems.
