KCV AMENITIES UPDATES:

TENNIS COURTS - OPEN
The Board made the decision to open the tennis courts May 1st. No more than 4 players may enter the courts at any time. The Board of Directors requests your compliance with these guidelines and asks that you please consider others when you are using the courts. Practice social distancing, arrive with clean hands, do not leave any items behind. The Board has advised onsite management to shut down the tennis courts at will if there is heightened concern for owners safety. The goal is that owners can engage in fun outdoor activities while remaining safe.

KCV POOL - OPENING UNDER MODIFIED OPERATIONS

OPENING DAY: WEDNESDAY JUNE 3, 2020

Temporary Hours of Operation until Further Notice:
Tuesday - Sunday 11:00 AM - 2:00 PM and 5:00 PM - 8:00 PM
Closed daily from 2:00 PM - 5:00 PM

The Kirby Creek Village Board of Directors met with the association attorneys and management company to consider its options and weigh any responsibilities they would incur when reopening the pool.

The pool will be opening Wednesday June 3, 2020.
Under current state requirements the pool occupancy must not exceed 25%. The association will provide two 3 hour time blocks for swimming with a 3 hour break for cleaning and rest for our monitors. The pool will close promptly at 2:00pm daily for cleaning. We request that you respect the time and vacate the area at closure so that the staff can clean the restrooms and test the pool chemicals to make sure it is ready for reopening later in the day.

The CDC encourages social distancing, and cloth masks, this will not be enforced by association staff as they are not medical professionals. These are CDC recommendations and we ask that you please respect other residents space when visiting the pool.

The KCV pool occupancy bather load as identified by the City of Grand Prairie is 48 people. We understand the pool area is very large, the pool itself is not that large and occupancy is based on water surface area. Therefore, under current restrictions only 12 people may enter the pool facility for use at any time, this does not include the two pool monitors.

You will be required to sign a waiver (Liability Release Form) to enter the pool facility whether you intend to swim or not. The form link will be posted at the bottom of this announcement.

The Association will not put out any furniture at this time. Permanent furniture will be roped off until further notice. Toys will not be permitted, this includes floats and rafts. Food or drink will not be allowed inside the facility with the exception of water. You can bring your own chair if you would like. Any items left behind will be thrown away.

All adults 18 and older will be required to show a valid state identification, pool management staff will verify that your account is current and that you have filled out a waiver to enter the pool facility.

At this time the Association requests that only residents use the pool during the first phase of reopening. In time the pool may open up to residents and their guests, but for the time being no guests are allowed.

We ask that you please respect other KCV residents as they will likely want to swim as well. Currently we are restricting swim times for residents to 1 hour a day . This request is at the direction of the Board of Directors. Our goal is that these times can increase as well as the occupancy numbers, however for now we are restricted to the current occupancy guidelines in place by the Governor and the City of Grand Prairie. When it comes to occupancy restrictions, please note that if the Governor of the state of Texas increases the occupancy levels we at Kirby Creek Village must go by what the City of Grand Prairie says. So if the City of Grand Prairie does not extend and increase occupancy numbers then we are required to follow what they advise until further notice.

Please note that the pool will continue to remain closed on Mondays as that is when our vendor comes out to mow.

We will keep in constant contact with the City of Grand Prairie as we proceed through the pool season. If modifications to restrictions become available we will work with the Board of Directors and Association Attorneys to reevaluate our current plan of action. Updates will be posted on the website, sent via the newsletter and posted at the pool facility by the clubhouse.

Here you will find a downloadable copy of the waiver (Liability Release Form) and an updated downloadable copy of the pool rules, they're also posted below. The pool rules posted in this document supersede the large metal sign posted at the pool. The new rules were drafted to reflect our current state of affairs as they relate to the COVID-19 Pandemic. The new pool rules will also be posted to our website and posted to the new display board being installed at the pool in the next few days.

CLUBHOUSE
The Board of Directors will not be opening up the clubhouse for rentals and we will not be taking reservations, this will be revisited in the future. Please understand that we know you love to use the clubhouse for parties and events but unfortunately we are in a situation where we are unable to do rentals at this time. Please know that we will be watching as the re-opening phases are documented by the state and we will try to comply and assist in the best way possible that fits our best practices and meets the needs of the homeowners in the safest way possible.

PARKING LOT
The parking lot will be open full time beginning June 3,2020. It will be blocked off at night when the pool closes at 8:00pm. It is not to be used for secondary parking or as a hang out spot. The parking lot is solely for residents using the pool or tennis courts. If the parking lot becomes an issue and we see increased problems we have been advised to close it indefinitely.

TRESPASSING
This is a reminder that the Board of Directors began actively enforcing no trespassing around the ponds and green spaces beginning Friday April 10, 2020.

As owners in the Kirby Creek Village HOA you will still be allowed to continue to walk your dogs, run, ride bikes, and walk the area along the path but you must keep moving and continue practicing social distancing when possible.

Gatherings of any kind around the ponds and green space areas are not permitted and will be considered as trespassing, this includes fishing. The Board of Directors approved additional signage and at the moment we have a total of 6 No Fishing signs installed on the grounds.

The Grand Prairie Police Department has been notified that we will be contacting them if we see gatherings around either pond or green spaces within the Kirby Creek Village Association common property. Also, please note, you as an owner have the ability to contact the police if you suspect suspicious activity within the Kirby Creek Village common areas. Please understand that while our goal is to stop all events of trespassing it is not entirely possible to monitor all areas at all times.

Our Onsite Management will do their best to address issues as they arise. Please note, our offices are closed on the weekends and our Onsite Managers will be handling the grounds. It is not acceptable to approach Matt or Jennifer regarding complaints, please direct those to the management office. If you have immediate concerns please contact the Grand Prairie Police Department.

Please exercise patience with Onsite Staff, the Management Office, the Grand Prairie Police Department, and Code Compliance as we are all working hard under very unique circumstances. If you have any other concerns please email our offices and we will address on the next business day.

OVERALL GUIDANCE
If for any reason we feel our community is in danger, someone falls ill, or owners are struggling to follow the guidelines in place putting other owners, vendors, or employees at risk we will close amenities as recommended by the Board of Directors, Local/State Governments and the CDC.

TEXAS SLOWLY REOPENS
KCV AMENITIES UPDATES:

Thank you so very much for your continued patience during the COVID-19 Pandemic closures. We know how frustrating it is to adapt to a new normal. The Board of Directors has been in constant contact with BFMC Property Management and the Association Attorneys as they make final decisions regarding Kirby Creek Village HOA. The Board of Directors has done an amazing job working together in the best interest of the association in accordance with the continually changing Executive Orders implemented by the Governor of the State of Texas. The Board will stay informed and continue to make decisions as orders permit.

TENNIS COURTS
As outlined in Governor Abbot's executive order GA-18, individuals may engage in outdoor sports, provided that the sports do not include contact with other participants, and no more than four participants play the sport at any time. Therefore, at this time the Board has made the decision to open the tennis courts. Beginning Friday May 1, 2020 the tennis courts will have the lock removed and access to owners will be permitted. In keeping with the Governor's orders no more than 4 players may enter the courts at any time. The orders also advised that only those in the same household should participate in group activities. The Board of Directors requests your compliance with these guidelines and asks that you please consider others when you are using the courts. Practice social distancing, arrive with clean hands, do not leave any items behind, and only play with those in your direct household. The Board has advised onsite management to shut down the tennis courts at will if owners are found in gross violation of these guidelines. The goal is that owners can engage in fun outdoor activities while remaining safe.

KCV POOL
In accordance with the State of Texas Executive Order GA-18 the pool is not permitted to be opened. Those orders are set to be reevaluated in mid May. We will provide updated information as it pertains to the KCV pool once it has been released. Annually the pool must pass city inspection prior to opening. Onsite management has been advised to continue the preparation procedures at this time with the understanding that the pool closure order may be lifted.

CLUBHOUSE
The clubhouse will remain closed for the month of May. We will continue to hold off on taking rental reservations until further notice. The Board of Directors will reevaluate any updated Governor's orders once they become available, and correspondence will be sent out regarding clubhouse rentals at that time.

PARKING LOT
The parking lot will be open for tennis court access only and will remain closed after hours.

BOARD MEETING
The April 2020 Board meeting was cancelled due to COVID-19 social distancing guidelines. Our goal is to be able to hold our next Board meeting on July 28, 2020. We will provide adequate notice if this date is to change.

In accordance with the Governor's orders, the Board of Directors asks that you continue to maintain necessary precautions to reduce the transmission of COVID-19 and to minimize in-person contact with people who are not in the same household.

Below is a copy of the detailed "Open Texas" report from the Governor's office. There is a lot of great information that does not necessarily pertain to the HOA but is good information regarding Texas and how the Governor plans to open our state during the Pandemic.

COMMUNITY UPDATES

Our new landscape crew has been working very hard over the past few months to get the association back in order. We are very pleased with their work and dedication in making Kirby Creek Village HOA beautiful. When they first started they noticed a large amount of debris, mostly tree and shrub trimmings, which had been dumped in some of the power line easements. The association had to incur cost of removal so that the landscape crew could mow those areas. The areas of concern stayed clear for a few weeks. As of this week the landscape rep contacted us to let us know that debris is starting to show up again in those same easements. To help ensure the association does not continue to take on large haul off costs please make sure you are discarding of tree and shrub trimmings properly. If you see someone illegally dumping items in those easements please contact our offices or the police immediately.

This week on Wednesday April 27, 2020 around 5:59pm a white truck drove over the cones and entered into the KCV parking lot. The occupant proceeded to wrap a chain around our dumpster and tried to offload his truck bed which was full of tree trimmings and gas cans. In the process the occupant became caught up on the dumpster and turned it around losing his load. Republic Waste had to dispatch a special dumpster crew to turn the dumpster back around so we could continue using the dumpster as intended and Republic Waste could empty according to schedule.

If you drove by the parking lot at any point this week you might have noticed a pile of branches sitting in the parking lot, this pile was from the truck bed. Thankfully our landscape crew at no cost to the association volunteered to haul off for us and it was all picked up today. We are hopeful by posting this video someone might come forward and identify the driver. This type of behavior can become very costly to an association. Below is the link to the surveillance video.

If you recognize the driver please contact our offices or the police.

SUSPICIOUS ACTIVITY

NOW MORE THAN EVER, KCV owners are needed to come forward to report suspicious activity or behavior to law enforcement! Suspicious activities can refer to incidents, events, individuals or circumstances that seem unusual or out of place.

Suspicious Activity. Some examples of suspicious activities include:
  • A stranger loitering near your home or a vehicle cruising the streets repeatedly;
  • Someone peering into cars or windows;
  • A high volume of traffic going to and coming from a home on a daily basis;
  • Open or broken doors and windows at an unoccupied residence;
  • Sounds of breaking glass, gunshots, screaming or fighting;
  • Strangers removing license plates or loading valuables into vehicles—even if the moving truck looks legitimate.
Suspicious Behavior. A few examples of suspicious behavior include:
  • Individuals acting furtively and suspiciously;
  • Individuals avoiding eye contact;
  • Individuals departing quickly when seen or approached; and
  • Individuals in places they don’t belong.

If you see suspicious activity or behavior, do not confront the individuals involved. Take note of the details:( S.A.L.U.T.E )

S - Size (Jot down the number of people, gender, ages and physical descriptions).
A - Activity (Describe exactly what they are doing).
L - Location (Provide exact location).
U - Uniform (Describe what they are wearing, including shoes).
T - Time (Provide date, time and duration of activity).
E - Equipment (Describe vehicle, make, color etc., license plate, camera, guns, etc).

Any type of activity or circumstance that seems unusual should be reported IMMEDIATELY to City of GP Police Department by dialing 911 for Emergency; or (972) 237-8790 for Non-emergency.

Thank you again for your continued support during the COVID-19 pandemic. We hope you and your family are doing well and look forward to opening all of the association amenities soon. Stay safe!
BELOW is a NEW update - April 19, 2020

THEFT OF KCV PROPERTY:

Hopefully by now you are all aware that we have closed off the parking lot and put a few temporary guidelines in place regarding the KCV common areas. We have restricted fishing, and social gatherings around the Kirby Creek Village green spaces for the time being so we can remain compliant with the Shelter in Place guidelines which are set to expire April 30, 2020. Of course we will post updates if things change.

We have had a few instances of theft over the past two weeks. Please note that we are actively investigating these occurrences. At this time we have had "no fishing" signs stolen and as of today a parking cone. While these may not seem like big ticket items, the cost to re-purchase the items stolen and pay onsite management to re-install does add up over time. If you know who might be responsible for the theft of these items please contact our offices. We will also accept back the stolen items if the person or persons responsible would please leave them by the Clubhouse Doors.

This is a video of the parking lot cone theft today. We will be passing along all video surveillance to the local authorities.

We understand you are all probably tired of being stuck at home and we are looking forward to when things will get back to normal again. We appreciate your continued support in keeping our community safe during this time.
BELOW is a NEW update - April 10, 2020

TRESPASSING ENFORCEMENT

As you know, the Association shut down the use of all amenities and access to our parking lot through 11:59 p.m. on April 30, 2020. This was in response to the amended Shelter in place orders on April 3, 2020.

This notice is to formally advise that the Association will begin actively enforcing no trespassing around the ponds and green spaces beginning Friday April 10, 2020 through April 30, 2020 and possibly even longer.

As owners in the Kirby Creek Village HOA you will still be allowed to continue to walk your dogs, run, ride bikes, and walk the area along the path but you must keep moving and continue practicing social distancing of at least 6 feet between you and all non family members.

Gatherings of any kind around the ponds and green space areas are not permitted and will be considered as trespassing, this includes fishing.

It is not acceptable to approach Matt or Jennifer as it will not meet the social distancing guidelines.

COVID-19 UPDATES:
Parking Lot and Amenity Closures

As you know, part of the Kirby Creek Village HOA is located within Dallas County, more specifically our amenity facilities and therefore we must address the following.

On April 3, 2020 Judge Clay Jenkins amended the Dallas County Shelter in Place order. This order is also referred to as the "Safer at Home" order. This order took effect at 11:10 a.m. on April 3, 2020 and will continue through 11:59 p.m. on April 30, 2020.

What does this mean for Clubhouse Rentals, Association Amenities and the April Board Meeting?

  • As noted in previous newsletters, we have suspended all clubhouse rentals through the end of April, we are also not taking new rental requests until further notice. Anyone who has a rental booked for May 2020 can keep their reservation at this time.

  • The tennis courts will also remain closed through April 30, 2020.

  • The April Board meeting will be postponed until a later date.

We will continue to monitor the Dallas county website to make sure we are compliant with regards to the shelter in place orders. If the orders are amended and extended then we will make adjustments to our closures. We will continue to keep you informed by sending out newsletters and posting the information on our website.

PARKING LOT CLOSURE

Our top priority is the safety of our homeowners, onsite staff and association vendors. We fully support the Shelter in Place orders implemented by Dallas County and will continue to find ways to help the Association remain compliant. This weekend we saw an influx of vehicles parked in the clubhouse parking lot. While we understand owners want to get out and enjoy the nice weather it is our duty to follow the state and county guidelines for social distancing. If we allow our parking lot to be accessible this opens it up to not only Kirby Creek Village owners but also anyone in Grand Prairie.

In order for us to continue our proactive measures it is in our best interest to close off our parking lot at this time. On Site staff has been instructed to cone off the parking lot effective Sunday April 5, 2020, the parking lot will remain closed through April 30, 2020. We will continue to watch for updates regarding additional extensions from the county. The parking lot will only be accessible to our On Site staff and Kirby Creek Village Vendors. Towing will be enforced.

SHELTER IN PLACE vs. DECLARATION OF LOCAL DISASTER EXPLAINED

One item to make note of is that at this time, Dallas County Judge Clay Jenkins has two orders in place.

The first is the Shelter in Place order, also known as the "Safer at Home" order which as mentioned above was amended on April 3, 2020. This is the order he extended through April 30, 2020 for all citizens of Dallas County.

The other order is called the Declaration of Local Disaster. On March 12, 2020, the County of Dallas proclaimed a Declaration of Local Disaster for Public Heath Emergency ("Local Disaster Declaration") which activated the Dallas County emergency Management plan.

On March 13, 2020, the Governor of the Sate of Texas issued a proclamation declaring a state of disaster for all counties in Texas.

On March 19, 2020 the Commissioners Court of Dallas County voted to consent to the continuance of the Local Disaster Declaration, extending the Local Disaster Declaration until 11:59 p.m. on April 3, 2020.

Then, on April 3, 2020 at 11:10 a.m. the Declaration of Local Disaster was extended until 11:59 p.m. on May 20, 2020 unless rescinded by order of the Commissioners Court and extends through May 20, 2020.

So what does this mean? Are we to shelter in place until May 20, 2020?

At this time the Shelter in place order is only in place through April 30, 2020. However, with the Declaration of Local Disaster extended through May 20, 2020 Judge Jenkins now has the affordability to extend the Shelter in Place order IF he deems necessary.

The following was posted on Twitter by Jenkins Friday April 3, 2020 further clarifying:

"The Safer-at-Home orders and the Disaster Declaration are separate documents and that the commissioner's court approved the extension to the Disaster Declaration, but that it was up to him to determine the effective dates of his Safer-at-Home order". He also noted, "the Safer-at-Home order will now run through April 30. I have the authority to extend the Safer-at-Home order until May 20 if needed, since the disaster declaration had been approved until that date".

In Summary:
The Disaster Declaration is NOT the same as the Shelter in Place order. As of right now Shelter in Place in Dallas County is only in place through April 30, 2020. However, the Disaster Declaration does allow Judge Clay Jenkins full capacity to extend the Shelter in Place order if he deems it necessary, through May 20, 2020. Therefore we at the Management office will continue to keep you informed as new information is posted by the County.

COVID-19 BOARD OF DIRECTORS NOTICE

Due to the COVID-19 pandemic the Kirby Creek Village Board of Directors has made the difficult decision to suspend clubhouse operations. All clubhouse rentals through the end of April 2020 have been canceled indefinitely. At the Direction of the Dallas County Health Department the Board felt this recommendation was required. All April rentals will receive a full refund.

Owners who have booked the clubhouse for May, June and July can continue to keep their reservation in place and as we receive additional direction from local and state authorities we can move forward with decisions that may or may not impact those bookings.

The Board also agreed that the BFMC Management Offices offices will no longer accept calls or email requests for future rentals until the current state of emergency has been lifted, at which time we will notify all owners we have reopened bookings.

In addition to the cancellation of all clubhouse rentals and suspension of bookings we have also closed the tennis courts indefinitely.

We understand the inconvenience this might cause owners, The health and safety of residents and our employees is of the utmost importance and therefore we must do our part to limit exposure. While we hope this is only temporary we sincerely appreciate your patience with this matter.

Please note that information regarding Covid-19 is fluid and you will continue to receive ongoing updates regarding Kirby Creek Villages efforts to work with the local and state authorities to slow the spread of the outbreak.

We will continue to update owners via this newsletter as well as post information on our website. Please do not hesitate to reach out to us with questions or concerns.

Kirby Creek Village HOA is located in both Dallas and Tarrant Counties, below we have posted a link to the City of Grand Prairies site regarding their COVID-19 response as well as links to both county health websites, and a link for the CDC. These sites will serve as a way to educate yourself on COVID-19 and how it has impacted your city and county, as well as have access to updated information directly from the Centers for Disease Control.

Thank you for your patience, we appreciate your partnership in helping keep our association safe, and we wish you good health during these unprecedented times.

BOARD OF DIRECTORS NOTICE

Below is an important communication to all owners at Kirby Creek Village from your Board of Directors concerning the issues we face within our Community regarding COVID-19.

Hello Neighbors!

The Board of Directors wanted to take a moment to reach out to all of Kirby Creek Village and give you an update on our current situation.

The current medical crisis affecting our nation, combined with the Shelter-In-Place order from Dallas, Tarrant and surrounding counties, has put us all in an unprecedented situation. Fortunately, the current guidelines consider the work done by our management team to be “essential” so our community manager, Angela Beené will continue to be able to be in the office a few days a week to check mail. Additionally, she is also logging in to her computer from home and does have access to email and voice mail. Matt and Jennifer, our onsite Pool and Clubhouse Managers are also able to work to keep the facility in running order. The Board has put in place some measures to try to help assure their safety, as well as the safety of all of our homeowners.

We have instructed Matt and Jennifer to not allow any owners or vendors inside the Clubhouse, Pool, or Tennis Courts at any time. This is to help ensure their safety and yours, as well as protect the Association, of which we are all members. If Matt or any of our vendors are onsite working outside, we ask that you observe the current CDC guidelines and leave at least 6 feet of space between you and them.

Angela, Matt and Jennifer as well as our Vendors do so many things for us, and are often able to respond so quickly to common area concerns. Please be aware that during this time, that type of immediate response may not be possible. Often the Association must go out and purchase supplies to conduct repairs, or hire specialists to help with a repair. Stores have limited their hours, some have limited supplies, and specialists are in high demand and face other limiting factors of their own. As always, the Board wants the needs of the Association to be met as quickly, efficiently, and professionally as possible. However, we all need to understand that there may be delays and additional challenges during this time. Please be RESPECTFUL to BFMC personnel, On-Site personnel and vendors and appreciate the fact that they are still out here, working hard, and putting themselves at risk for our benefit. We all need to exercise patience and kindness as we encounter problems.

The number one issue that arises at Kirby Creek Village are grounds related. In this time where we as a nation are trying to stay healthy and safe please keep in mind as you are walking the grounds with your family or pets to please make sure you are discarding of trash and dog feces in the proper receptacles.

Angela does a great job of letting our homeowners know what is happening and keeping us all up to date via the newsletter and the website. Please check your email and the website often, as she will update us any time there is an issue that has arisen in the Association.

The Board has also been informed that the BFMC Property Management offices are closed to outside visitors during this time. All communication with the management team should be conducted via email or over the phone. The clubhouse will also not be available during this time, and our pool and tennis courts will remain closed.

As you enjoy the community when out walking, give a friendly “hello” to your neighbors, just do it from at least six feet away. Let neighbors finish getting their mail out of the cluster boxes before you step up and get yours. Also, please make sure you are putting ALL your trash out ONLY on your established trash day, and make sure the trash bags are secure to prevent loose items from blowing through our neighborhood.

We have heard about several people offering to help neighbors who cannot or should not be out during this time. If you need help please feel free to contact the Management office and they will do their best to point you in the right direction. Please keep in mind that emergencies are to be directed to the Grand Prairie Police Department via 911. For informational assistance you can call 311 for Dallas County and 817-884-1212 for Tarrant County.

While this is a stressful time for many, I know that the homeowners of Kirby Creek Village will handle this challenge with dignity and respect for all.

Sincerely,
