FFCRA Leave Questions
The HR update linked below answers some timely FFCRA Leave questions employees might have in regard to their kids returning to school:

  • Can I take paid leave under the FFCRA if my school only offers remote learning? Yes – up to two weeks of paid sick leave and up to 12 weeks of expanded family and medical leave (10 of which are paid.)

  • Can I take paid leave under the FFCRA if my school gave us a choice between remote learning and in person classes and I choose remote learning? No – you are not eligible to take paid FFCRA leave because your school is not closed.

  • Can I take paid leave under the FFCRA if my school is operating on alternate days or other hybrid-attendance options? Yes – you are eligible to take paid FFCRA on those days when your child is not permitted to attend school in person as long as you need the leave to actually care for your child during that time and only if no other suitable person is available to do so.

Can You Afford the Loss of a Key Employee?
If you’re like most business owners, you have one or more go-to employees when it comes to the day-to-day operation of your company. They have the management skills, technical know-how, experience, or customer relationships upon which you rely — you trust them to make the right decisions when you’re not available. They can be at any level or in any position, but they are people your business can’t do without. Now that you have them on your team, what would happen if you were to lose one of them due to a premature death, long-term illness or disability, or another employment opportunity?

What Causes Accidents?
Would you call yourself or someone you know “accident prone?” While the whole notion of being naturally susceptible to mishaps and injuries is debatable, on-the-job injuries have a number of recognized causes.

Stress, fatigue, job dissatisfaction, emotion, and personal problems create short-term or isolated situations that can result in chance accidents. But other factors related to day-to-day operations are more likely to cause accidents. Concentrate on this type of hazard to help protect yourself and your co-workers.

Provide FFCRA Leave Even in Negative Cases?
Question
We have many employees who have figured out that some doctors will write 14 day quarantine notes, even after they test negative for COVID. The employee goes to the provider, tells them they've been exposed to COVID, the doctor tests them, they come back negative, but then the doctor writes a 14 day quarantine order anyway and the employee submits that for FFCRA sick time. I don't see a way around this due to how the law is written, but it is getting very over-abused. Are we correct that we must provide the FFCRA leave whenever a doctor note advises it even in negative cases?

Executive Order Directs IRS to Defer Certain Payroll Tax Obligations
SEPTEMBER 2020 HUMAN RESOURCES BULLETIN

On August 8, 2020, President Donald J. Trump signed an executive memorandum that directs the U.S. Department of the Treasury to defer certain payroll tax obligations for employees in order to lighten their financial burden during this ongoing COVID-19 pandemic. In addition, on August 28, 2020, the Treasury and IRS issued Notice 2020-65 to further articulate how this tax deferral will be implemented. It is important to note that this program only delays the payment of the taxes; tax obligations are not forgiven.

Preparing to Deal With Employee Absences as Schools Move to Remote and Alternate Schedules
“As the fall nears, the school year is about to kick off. While employees juggling work and school obligations can always present an issue, this year could prove to be a little more complicated than usual. Although some schools are preparing to go back to school inperson, others are utilizing a variety of modified schedules, or going totally remote.”

As the EEOC Resumes Sending out Right-To-Sue Letters, Employers Should Expect an Increase in Discrimination Lawsuits
“In a little-publicized move near the beginning of the U.S. coronavirus lockdown, the EEOC temporarily suspended issuing right-to-sue letters with respect to most charges of discrimination. That decision was made as a part of the EEOC’s efforts to operate in accordance with public health guidelines. Since March 21, 2020, right-to-sue letters have typically been issued only to charging parties who have requested them. However, the EEOC resumed sending out right-to-sue letters on August 3, 2020, and announced that any suspended notices would be sent out between that date and September 30, 2020.”
