Resident Architectural Committee (RAC)
Covenants Corner
Greetings, Oakland Mills residents, and welcome to the Covenants Corner!

Here are this week's Covenants Corner tips:

Are you having Covenant Confusion? We wanted to clear-up some common misconceptions about the covenant process this week.

Covenant Violations:
  • Myth: OMCA goes out looking for violations!
  • Truth: Our system is complaint driven, meaning we DO NOT go out searching for violations. In addition, when reporting a suspected covenant violation, you must include the exact property address and the specific violation concern(s).
  • Myth: If I submit a complaint my personal information will be shared.
  • Truth: Violations can be (and most are) filed anonymously. And unless a complainant specifically asks us to share their information we cannot and will not share that information.
Exterior Alteration Applications:
  • Myth: Having to apply is going to cause major time delays for my project.
  • Truth: Application approvals are complete within 60 days. If an application is tabled due to lack of information or absence of the owner at the review meeting it may take longer. So please contact Covenant Advisor Carrie Wenholz to ensure she has everything needed in advance of the meeting AND come to the meeting. You are your own best advocate!
  • Myth: The Resident Architecture Committee doesn't like to approve changes.
  • Truth: The committee REALLY wants to recommend approval of every application! They will work with the owners to ensure that the alterations are in keeping with the overall architectural style of the home and in compliance with architectural guidelines and covenants.
Letters of Compliance:
  • Myth: Houses MUST be compliant and without violations to be sold.
  • Truth: We highly suggest that everyone obtain a Letter of Compliance when selling their home but we CANNOT require or FORCE them to. Therefore, houses CAN be sold in a non-compliant state. It is important for sellers and buyers to speak with their realtor and/or lawyer about state and federal laws pertaining to property compliance.
  • Myth: I am buying a house in Oakland Mills so I should be able to request a Letter of Compliance.
  • Truth: Only the owner or their real-estate agent is able to submit a request for letter of compliance inspection. Once a letter of compliance (or non-compliance) is issued the owner is legally required to disclose it to potential buyers.
If you have a specific question about any of these or other topics, email us at propertyconcerns@oaklandmills.org . Your question may be highlighted in a future issue of the e-news!
