Happy 4th of July Weekend to All...So what's New?

Portability of Tax Base - As many of you are experiencing, our market environment is busy and homes are selling. I want to share good news and a victory in the legislative/advocacy arena on behalf of property rights.
ACA-11 known as the “The Home Protection for Seniors, Severely Disabled, Families, and Victims of Wildfire or Natural Disasters Act” (ACA-11). was approved by our legislature and added to this November's Ballot.
 
What does this mean ? If passed, this proposition will continue to expand Proposition 13 property tax portability to seniors over 55, disabled and disaster victims. The legislation also supports fire services, emergency services, schools and more. With this passing, we can look forward to a thriving real estate market in the new year in Nevada County because it lends itself to a new opportunity for those who have been waiting to sell their homes and move to their desired county within CA .   • Governor Newsom issued a New Executive Order N-71-20 which extends several provisions of his prior Orders N-52-20 and N-69-20 has updated Covid-19 orders and there are items that affect our industry. Please refer to the Department of Real Estate COVID-19 Resource Page. Please note that the Executive Order N-71-20 also extends authorization for local governments to halt evictions for renters impacted by the COVID-19 pandemic, through September 30.
  • NCAOR pulling month-end and Quarter-End Statistics on Monday. Please enter your sales in the MLS so that we can pull our statistics on Monday in an accurate fashion..
  • Upcoming MLS changes next week – The new dashboard
  • zipform is now referred to as "Lone Wolf Transactions" yet no features or functionality has changed.
  • MetroList to launch our new local Nevada County Dashboard on the MLS next week. We will now be able to post our local messages, links and events directly on the MLS homepage.

C.A.R. Legal Guidance on Open Houses – as of 7/2/20 - T o follow-up to our discussion at Wednesday's marketing session, our AE met with CA Association Executives and C.A.R. legal counsel this week.to address and create more clarity regarding the "Open House" practices.

C.A.R. Counsel Gov Hutchinson offers the following: There still seems to be some confusion in the state regarding the legality of holding open houses. Please be reminded that open houses are not currently permitted in California. The mandatory Industry Guidance states “ Discontinue holding open houses and showings open to the general public on a walk-in basis; use an appointment or digital sign-in process to control the number of people in the house or property .” Thus, the only way to show property is by making an appointment in advance. Visitors viewing a house should be from one buying party only and the number of persons in the property is limited by the requirement of social distancing. In addition, the property must be thoroughly cleaned before and after each showing.
 
Open houses are generally understood to be on a walk-in basis without needing an appointment. Appointment-based showings are not “open houses” in the general understanding of the industry and the public. Therefore, to present a true picture under Article 12 of the Code of Ethics, REALTORS® should conform to the normal understanding of the term .
 
In other words, REALTORS® should not be putting up Open House signs at all, because if they are advertising a traditional open house they are promoting an unlawful activity, and if they are advertising an “open house” that really isn’t an open house, they are arguably not presenting a true picture in their advertising.

Bylaws Ballot & Election Slate Being Distributed to REALTOR Membership
Management will be distributing some limited proposed NCAOR Bylaws Amendments to meet our changing landscape in the industry this year, along with the upcoming 2021 Slate of Officers and Directors for our Association that reflect those changes.

When received, please take a few minutes to review the email and respond back with a "Yes" or "No" on the proposed Bylaws amendments and review the slate for 2021.
Fired Up About Housing 1st Time Homebuyer Grants Available - 7 more issued this week. Log onto our website, nevadacountyhomes.com , click on the NCAOR Tab at the top of the home page , go down to forms and you can access the grant program under "print applications" (4th application from the bottom of the section) or CLICK HERE . Please read the grant guidelines and qualifications carefully.

Thanks to our NCAOR Housing Affordability Committee and the C.A.R. Housing Affordability Fund, you can apply up to 30 days after Close of Escrow to see if your client(s) qualify for a $1,000 grant.
