Bailey & Wyant, PLLC leaped into February with an eye on diversity and spirits flying high. This February, our attorneys warmed up while attending meetings in Miami, FL, as well as turning up the heat with a series of speed interviews with local law students. Read all about it below!
 FLSA Claims On the Rise


Fair Labor Standards Act claims are on the rise!  To help prevent litigating these sorts of claims, it is necessary for employers to do a top to bottom review of employee job descriptions in order to determine what employees are exempt under the FLSA.  The FLSA provides a list of exemptions for minimum wage requirements, maximum hour requirements, and child labor requirements.

Generally, employees who can be classified as executives, administrators, professionals, certain computer employees, and outside salespersons are exempt from the FLSA requirements.  Employers who preform manual labor or other "blue collar" workers do not fall under the FLSA exemptions.  An employee's title alone, however, is not enough to determine whether a given employee is exempt under the FLSA.  Depending on how an employee is classified, the employee must satisfy a "salary test," a "duties test," or both tests.  These tests, and whether an employee need only satisfy one of both, are laid out in considerable detail under the Code of Federal Regulations.


Bailey & Wyant, PLLC Attends DTCWV's Annual Speed Networking event at WVU College of Law


Bailey & Wyant, PLLC  Members David Mincer and Suleiman Oko-ogua, along with other attorneys, had the pleasure of interviewing 41 law students for the DTCWV's Annual Speed Networking event at WVU College of Law. During this event, first year law students undergo mock interviews facilitated by attorneys. After providing their responses to the attorneys' questions, the students are given feedback from each attorney.

The purpose of the speed networking event is to prepare students to interview for summer internships. By preparing for future interviews, these students have the knowledge and confidence to secure an internship that will launch them into a successful career in law.

LCLD 3rd Annual Meeting in Miami, FL



Bailey & Wyant, PLLC, Member Jennifer Tully attended the Third Annual Meeting of the 2019  Fellows Meeting for the Leadership Conference on Legal Diversity (LCLD).  

Since its inception in 2009, t he LCLD has grown to an organization of more than 320 Members, who serve as either general counsel of major corporations or managing partners of the nation's leading law firms.  The Fellows Program works by identifying high-potential attorneys from diverse backgrounds and setting them on the path to leadership of their organizations.  

Mrs. Tully has enjoyed being a part of such a wonderful organization and is looking forward to continuing not only her commitment but also the commitment of Bailey & Wyant's to diversity within the legal community.

Bailey & Wyant, PLLC Managing Member, Charles R. Bailey, and Member, Daniel LeMasters, attended the Spirit Airlines kick off at Yeager Airport on February 14.

Spirit Airlines will be providing non stop service from Yeager Airport to Orlando, FL.

Pictured with Mr. Bailey is Spirit Airlines' General Manager of Charleston Services, Michael Penland.  Penland told Metro News,"I think it's a great opportunity not only for our team locally to serve the community, but also for the community to take advantage of this opportunity to have a high valued vacation to a warm weathered city."


Michael Taylor presents at the West Virginia Association of Counties Conference at Embassy Suites



Bailey & Wyant, PLLC Member, Michael Taylor, gave a presentation on medical marijuana in the workplace at the West Virginia Association of Counties Conference at Embassy Suites.

Michael spoke to county officials about county government and how they can handle medical marijuana in their counties and workplaces. The presentation also included an update on the current status of medical marijuana in West Virginia.

Equity Member, Marc Slotnick, Member Amy Haynie, Associate Jessica Harper and not pictured, Bailey & Wyant, PLLC, Member Daniel LeMasters attended the YWCA 2020 Women of Achievement Luncheon at the Charleston Coliseum and Convention Center.

The Mission of the YWCA is to eliminate racism, empower women and promote peace, justice, freedom and dignity for all.  This year's 15th annual YWCA Empowerment Award winner was Deborah Harris.  This honor is awarded to a YWCA client who has overcome significant adversity through the support from one of more of the programs.

Also recognized as 2020 Achievement Honorees were Charleston Mayor, Amy Shuler Goodwin, Dr. Michelle Foster, Sandra M. Murphy, Esq., and Woman to Watch, Morgan Rhea Beals.

Albert C. "Abbie" Dunn, Jr. Esq. obtains defense verdict



Bailey & Wyant, PLLC's, Of Counsel, Albert C. "Abbie" Dunn, Jr. Esq., obtained a defense verdict in Lincoln County February 5th.  A trial of property damage where a suit brought by a property owner against a logger.  The Property owner contended that the logger's activities failed to comply with the WV Division of Forestry's best Practice Management guidelines.
