Premium Processing for H-1B Cap Cases
  
The U.S. Citizenship & Immigration Service (USCIS) announced its premium processing plan for FY2020 H-1B cap-subject petitions that will be filed between April 1-5, 2019.

Premium Processing for FY2020 Cap-Subject Petitions will be offered in two phases:
  1. Petitions requesting a "change of status" (COS) may be filed under Premium Processing IF the premium processing request is filed concurrently with the H-1B petition.  That is, the H-1B COS petition must be filed under premium processing between April 1-5, 2019.  USCIS will begin processing these petitions no later than May 20, 2019.

    If a petitioner does not file Form I-907 concurrently with an FY2020 H-1B cap-subject petition requesting a change of status, the petitioner must wait until the 2nd phase of premium processing reinstatement to convert their cases to premium processing.
     
  2. Premium processing for all other FY2020 cap-subject H-1B petitions will not begin until at least June 2019. Cap-subject petitioners not requesting a change of status may not submit their premium processing request concurrently with their H-1B petition. These petitioners will be eligible to upgrade to premium processing once premium processing begins for this group. 
Individuals for whom we are about to file H-1B cap cases as a "change of status" who want their petitions filed under premium processing should mail a check to my office address as follows:

Payable to:          U.S. Department of Homeland Security
Amount:              $1410
 
If the check is not drawn on the bank account of the employee whose case we are to file under premium, please put the name of the employee for whom the premium processing check is intended in the memo field of the check.  Cashiers checks are also acceptable.
 
If you have already submitted a check for premium processing that is payable to my office, I will issue the check to the USCIS.  There is no need to send a new check.
