Illinois General Assembly

T he General Assembly  has adjourned until the fall veto session.  


Illinois Department of Revenue
The Department issued Information Bulletin FY 2020-31 "Change in the Motor Fuel Use Tax Rate, Effective July 1, 2020, through December 31, 2020.

City of Chicago
The City of Chicago recently posted Phase III Cautiously Reopen - Industry Guidelines for Reopening.  

Cook County
Cook County President Preckwinkle recently issued Executive Order 2020-11.  The Executive Order provides that directives to employees in the Office of the President and the Cook County separately elected offices regarding whether to work on-site, remotely, or a combination of both will continue to be consistent with the State "Restore Illinois" plan.  

The Executive Order provides that it is anticipated that a first wave of employees as identified by Department Heads, Bureau Chiefs and the separately elected offices will return to work in County buildings and facilities on June 15, 2020.

The Executive Order also states that it is anticipated that Cook County Buildings and facilities will be re-opened to the public on July 6, 2020.  The re-opening may continue to occur in a phased-in approach and require the public to adhere to social/physical distancing standards and other requirements as directed by the County.


Rulemaking
The June 12  edition of the Illinois Register did not contain any proposed or adopted rulemakings of the the Illinois Department of Revenue or the Department of Commerce and Economic Opportunity.

Court cases
Central Nursing Realty, LLC v. Property Tax Appeal Board.  This case is a challenge to a decision of the Property Tax Appeal Board relative to assessing the value of real property.  Central Nursing argues that the Board overstated the fair market value of the property and failed to consider its argument and supporting evidence that the property was inequitably assessed in comparison to similar properties.  In a detailed opinion the appellate court upheld the decision of the Property Tax Appeal Board.

Tax Tribunal 
No new decisions were issued by the Tribunal this week. 

Only one new case was filed with the Tribunal this week.  The case is a personal responsibility penalty case that does not appear to raise any unique issues. 

Publications
The Institute on Taxation and Economic Policy ("ITEP") recently issued a report entitled Depreciation Breaks Have Saved 20 Major Corporations $26.5 Billion Over the Past Two Years. ITEP is lobbying to eliminate immediate expensing under the Internal Revenue Code and eliminate accelerated depreciation.  ITEP ignores that fact that immediate expensing does nothing more than shift deductions to one tax year, rather than spreading the deduction over a number of years. The amounts expensed in the year an item is purchased and placed in service aren't available in subsequent years.

I track ITEP publications, because some legislators turn issues raised by ITEP into Illinois legislation.

The Illinois General Assembly's Commission on Government Forecasting and Accountability recently issued its  Revised FY 2021 Revenue Estimate and FY 2020 Revenue Update
