OMH Legal has concerns with the current SPOA release language included on the SPOA universal form, as it does not explicitly provide for the data received by the SPOA to be redisclosed to any third party, nor is the patient or their guardian clearly apprised that they are authorizing such redisclosures.
Until OMH Legal and CLMHD are able to meet and amend the form, the best practice would be:
• To add whatever third party needs to receive the referral packet to the list of authorized agencies (in this case it would be CYES) on page AND
• Note on page 4 whatever information the third party needs to receive AND
• Inform the patient and their guardian the reason this third party agency is receiving the information and how the information is being used.
