DoD CMMC Requirements Begin Rollout November 30

Recently, the DoD issued an interim rule that will update the DFARS to implement the assessment methodology and CMMC framework for DoD procurements as well as add a new requirement for cybersecurity assessment under the NIST SP 800-171 framework. Here are some of the key points.

The interim rule will be effective November 30, 2020, which is also the date that comments are due. I suspect there will be a lot of comments for this rule, so it’s interesting that the effective date and the deadline for comments are the same. I would suggest getting comments in early to have a better chance of DoD reviewing them.

NIST SP 800-171 Rule
This rule will implement both the National Institute of Standards and Technology (NIST) Special Publication (SP) 800-171 DoD Assessment Methodology and the CMMC Framework. But DoD asserts that the two “assessments will not duplicate efforts from each assessment.”

SBA Issues Sweeping Regulatory Changes in Response to Presidential Initiative

The Small Business Administration (SBA) recently published a much-anticipated final rule on a series of important regulatory amendments, including the:

  • Consolidation of the 8(a) Business Development (BD) Mentor-Protégé Program and the All Small Mentor-Protégé Program;
  • Elimination of the requirement that 8(a) participants seeking to be awarded an 8(a) contract as a joint venture (JV) submit the JV agreement to the SBA for review and approval prior to contract award;
  • Elimination of the so-called “three in two rule;” and
  • Requirement that a business concern recertify its size and/or socioeconomic status for all set-aside orders under unrestricted multiple award contracts.
