California Attorney General Becerra Issues Advisory Outlining New Data Privacy Rights for California Consumers

The California Consumer Privacy Act is in effect as of January 1, 2020. Attorney General Xavier Becerra has issued an advisory for consumers highlighting their new rights as part of the California Consumer Privacy Act (CCPA), which went into in effect on January 1, 2020. The advisory describes consumers’ basic privacy rights under the CCPA and methods for consumers to exercise those rights, information about the data broker registry, and new guidelines related to data security. Enforcement of CCPA is the responsibility of the Office of the Attorney General.

Opioid Crisis Concerns Spread to Data Privacy

In a recent ruling by opioid MDL Judge Dan Polster, 14 years of patient’s prescription data has now been ordered released by the nation’s largest pharmacies to the thousands of plaintiff’s in the landmark Ohio based opioid MDL litigation. Attorneys General are not formally parties to the MDL litigation but as the nation’s privacy champions have yet another reason to care about the MDL litigation is impacting their constituents. Attorneys General, law enforcement, health care privacy advocates, privacy advocates have all feuded for years – usually in the PDMP context – to keep exactly this same information from being data mined or released to anyone except when the information is narrowly tailored and court overseen. This latest order implicates literally billions and billions of patients health records.

Illinois Attorney General Raoul Urges ICC to Return Hundreds of Millions of Dollars in Excess Tax Money to Consumers
January 6, 2020
Attorney General Kwame Raoul filed two requests with the Illinois Commerce Commission (ICC) to rehear and reconsider its decisions in the ComEd and Ameren Illinois formula rate cases that allow the companies to hold onto hundreds of millions of dollars in consumer refunds for a period of more than 35 years.

Arizona Attorney General Brnovich Sues Juul Labs, Inc.
January 7, 2020
Attorney General Mark Brnovich announced that his office filed a Consumer Fraud lawsuit against Juul Labs, Inc. (JUUL), regarding the advertisement and sale of JUUL’s vaping devices and vaping pods to Arizonans, including JUUL's exploitative marketing towards Arizona’s youth. The lawsuit was filed Tuesday morning in Maricopa County Superior Court.
The United States Surgeon General has described youth e-cigarette use as an “epidemic,” and the former United States Food and Drug Administration Commissioner has pointed to JUUL as a significant cause of the problem. Youth vaping now dramatically outpaces youth cigarette use nationally and in Arizona.

Florida Attorney General Moody Recognizes National Human Trafficking Prevention Month
January 6, 2019
Attorney General Ashley Moody is recognizing January as National Human Trafficking Prevention Month by highlighting resources on human trafficking and how to report it. According to the International Labor Organization, forced labor and human trafficking is a $150 billion industry globally with an estimated 40.3 million victims worldwide. With Florida hosting multiple high-profile events in the coming months, human traffickers may try to take advantage of the festivities to profit off the pain of others.
