Bailey & Wyant, PLLC continues to thrive during these times of uncertainty.  March was full of excitement with the swearing in of a new Member and the beginning of social distancing.  We continue to support our clients from a distance and have even perfected the art of virtual Real Estate closings.  With April coming to a close in the next few days we look forward to a prosperous May.

Bailey & Wyant, PLLC congratulates Associate Samuel M. Bloom on his Admission to the WV State Bar.  Samuel is a native of Charleston and will be practicing in the downtown Charleston location.  He holds his undergraduate BA degree in Philosophy from WVU as well as his graduate Law Degree from the WVU College of Law.  Samuel's practice areas of interest include; Personal Injury, Employment Law, Civil Rights, Municipal and Political Subdivision Liability, and General Civil Litigation.

Bailey & Slotnick, PLLC's Equity Member, Marc Slotnick and his team continue to thrive during these unprecedented times.  Marc along side with Member Amy Haynie and Associate Jessica Harper maintain business as usual, well in regards to the "new normal." 
 
Marc has been able to utilize ZOOM conferencing to communicate with area real estate brokers as well as the WV Association of Realtors.  He has been a guest speaker via ZOOM with Berkshire Hathaway and Real Estate Central to discuss and assist with closing processes during the pandemic.

LCLD meeting at WVU College of Law

 
 
Bailey & Wyant, PLLC, Member Suleiman Oko-ogua attended the March Meeting for the Leadership Conference on Legal Diversity (LCLD) held at WVU College of Law.   
 
Suleiman has authored and recently published an article titled, "Overcoming Bias and Perception."   The full article can be view at the link found below.  In this article he discusses his own experiences with implicit bias throughout his legal career.   
 
One excerpt from the article reads, "Diversity should be a constant conversation around every conference room table.  It needs to start with awareness and end with inclusion.  We should all be challenged and inspired to embrace individuals within the legal profession from more diverse backgrounds and support them in our united goal to enhance the legal profession and move it forward together.' 
 
Since its inception in 2009, t he LCLD has grown to an organization of more than 320 Members, who serve as either general counsel of major corporations or managing partners of the nation's leading law firms.  The Fellows Program works by identifying high-potential attorneys from diverse backgrounds and setting them on the path to leadership of their organizations.  

 
 
 
 
 
 

Bailey & Wyant, PLLC obtain summary judgment
 
Bailey & Wyant, PLLC Managing Member, Charles R. Bailey, and Member, Jordan Herrick, obtained a summary judgment in the United States District Court for the Southern District of West Virginia on behalf of a prison medical care provider and its employees.
 
The plaintiff was an inmate at Mount Olive Correctional Complex and alleged that the defendants violated his Eighth Amendment rights by acting with deliberate indifference to his serious medical needs when he developed a health condition that ultimately led him to being hospitalized.  The Court found that the medical care provider and its employees provided proper medical treatment and did not act with deliberate indifference and therefore, awarded the defendants summary judgment.  
 
 
Bailey & Wyant, PLLC, granted dismissal
 

 
 
Bailey & Wyant, PLLC's Member, Jordan Herrick and Associate, Harrison Cyrus were granted dismissal by the United States District Court for the Southern District of West Virginia.  The defendant was an out-of-state insurance agency which insured a trucking company that employed a trucker who was involved in an accident in WV.  The plaintiffs alleged that the insurance agency undertook to perform services,  including evaluating and screening new-hire drivers for the trucking company, including the trucker, and, that the insurance agency was negligent in performing these tasks.  The Court found that there was a lack of personal jurisdiction over the out-of-state insurance agency and dismissed it from the lawsuit.

Bailey & Wyant PLLC's Marketing Director, Tracey Wilson won the Women's Singles draw in the 2020 WV Open, and placed as a finalist in the Doubles category.
 
Tracey is a native of Dayton, OH and an alumni of the University of Dayton. She relocated to Charleston in 2007 to continue her career in sales and business development.   She joined the Bailey & Wyant PLLC staff in February of this year.
