Controversial immunization bill passes Senate committee

This week the legislature took up a new bill aimed at addressing Colorado's low vaccination rate. Senate Bill 163 was heard in the Senate Health and Human Services Committee last Wednesday and passed on a 3-2 vote. The bill has a small appropriation, so the next stop will be the Senate Appropriations Committee before heading to the Senate floor for debate.

The short title of Senate Bill 163 is "School Entry Immunization" and it concerns the modernization of the school entry immunization process. The proponents cite Colorado's kindergarten vaccination rate, currently the lowest in the country, as motivation for making changes. And contagious diseases like measles can have serious consequences. Their solution is to make changes that will improve vaccination rates and support public health efforts.

The bill is different from last year's bill in a couple of ways so let's break it down. The bill (please read the actual text as this is merely a short summary) will: 
  • Establish a statewide standard of 95% vaccine coverage for all Board of Health required immunizations for school entry; 
  • Consolidate religious and personal belief exemptions into one "non medical" category
  • Require a state-issued form signed by an immunizing provider in order to claim the non-medical exemption; or,
  • Allow parents electing a "non-medical" exemption to complete an online educational module created and administered by CDPHE;
  • Direct the immunizing provider to upload the form to CIIS, the Colorado Immunization Information System; and
  • Require schools and child care providers to proactively notify parents/guardians annually of their immunization rate relative to the new Vaccine Protected Children Standard (beginning in 2021).
I have received (literally) hundreds of emails both in favor and opposed, so I cannot go into great depth on the various arguments here, but I can summarize some of the themes:

Those opposed are concerned about the violation of their religious and/or personal beliefs and worry that a provider may deny them the signature needed to receive the exemption. Some object to the online module describing it as a "re-education" tool akin to propaganda. And others are worried about data privacy and the possibility of persecution or bullying if their children's information is made public.

Those in favor are worried about our state's low vaccination rate and that 63% of all students in our state are without full protection from vaccine-preventable diseases. There are negative public health consequences, especially to vulnerable populations--the very old, the very young, and those with health issues--that aren't safe in their own communities. And the majority of Coloradans (84%) believe that vaccinations should be required to attend public school or child care facility. 

I look forward to hearing this bill with all these concerns in mind. While I do promote families' autonomy in making choices for their children, some matters cross over the private lines of autonomy and into our shared societal jurisdiction. I think we have a compelling duty to set health standards for our schools, as long as we continue to do a good job of providing space for exceptions. If the proposed changes do not strike a proper balance, I hope we can amend the bill to address those concerns.

SB20-175 Assessment Score On A Student's Transcript.  Concerning the prohibition of indicating an assessment score on a student's high school transcript. This bill will be heard in the Senate Education Committee on Thursday, February 27 at 1:30 pm.

I participated in the Legislator Q&A with the GT students... I presented and passed my bill SB20-125 on Circus Animals out of the Senate Ag Committee... I attended the Colorado Health Care Association legislative reception... On Friday, I attended the Arvada Chamber of Commerce Community Impact breakfast... I met with Students from Regis University... The JBC heard figure setting recommendations for the Department of Local Affairs, the Department of Revenue, the Treasury, and the JBC FY 2020-21 Operation Budget.
