Illinois General Assembly

The House and Senate were not in session this week. The House has cancelled the session days originally scheduled for next week. According to the Illinois General Assembly website, the next session day scheduled for the Senate is listed at May 5.  The House does not have a next scheduled session day posted on the website as of this morning. It remains unclear when the General Assembly will return to Springfield. 

The committee deadline (the deadline for moving House and Senate bills out of committee to the floor in the chamber of origin) had been extended to April 24. Yesterday, the House announced that the deadline for moving House bills out of committees was extended to May 7.

The House extended the third reading deadline to May 15. 

The Senate previously extended the third reading deadline for Senate bills to May 7. I haven't seen an announcement yet extending the Senate deadline.

COVID-19 state tax-related announcements
The Illinois Department of Revenue issued a Notice of penalty and interest relief through May 26, on late-filed, first quarter International Fuel Tax Agreement (IFTA) returns due April 30, 2020. To take advantage of this waiver, file your first quarter 2020 IFTA return electronically by May 26, 2020.

Cook County
Cook County maintains a webpage COVID19 Response - Information for the Business Community.  This site appears to be updated regularly.

IRS 
The Internal Revenue Service has established a  Coronavirus Tax Relief web page. Note that IRS IRS updated the page over the past week.

Rulemaking  
The April 17 edition of the Illinois Register adopted amendments to the rules for the Cigarette Tax, Cigarette Use Tax, and the Tobacco Products Act. The rules are updated to reflect the increase in the cigarette tax rate passed last spring and the Tobacco Products rules are amended reflect the increase in the tax on little cigars and the taxation of e-cigarettes.

The April 24 edition of the has not been published by the time I completed the newsletter this morning.

Court cases
No new tax-related decisions this week.

Tax Tribunal 
No new decisions were issued this week.

One new case may be of interest.  JSS Holdings, Inc., JSS Holdings LLC, and JSSI Management Enterprises LLC v. Department of Revenue was filed by Mike Wynne of Tax Institute member law firm Jones Day.  This case involves claims for refund and whether and to what extent a "Notice of Claim Status" issued by the Department in response to the filing of a claim for refund may be a protestable notice of claim denial.

Eric Fader of Tax Institute member accounting firm BDO is presenting a State Tax Update to the Fox Valley Chapter of the Illinois CPA Society on May 7.  I'm not sure how registration for this webinar works for non-members of the Fox Valley Chapter so I suggest you contact Eric for additional details.
