TAA and BAA Compliance

Part 2 of 2 (TAA)
The laws implementing the U.S. Government’s preference for domestic products are known the Buy American Act (BAA), and the Trade Agreements Act (“TAA”) . The TAA allows for the procurement of products from certain countries other than the United States.
WHAT IS TAA?

The Trade Agreements Act of 1979 (TAA) requires that the U.S. Government may acquire only “U.S. – made or designated country end products.” TAA requires that products must be produced or undergo "substantial transformation" within the United States or a designated country.

SUBSTANTIAL TRANSFORMATION

The TAA employs a different qualification test, called the “Substantial Transformation Test.” The determination of whether there has been substantial transformation for TAA purposes is whether the product has been given a different character or use as a  result of the manufacturing process it underwent in the U.S. (or designated country).

TAA QUALIFYING COUNTRIES:
If a product is not BAA compliant, TAA allows the product to still be purchased by the U.S. Government.

For example, Department of Defense (DoD) procurements allow the use of products from “Qualifying Countries” without penalty. A list of TAA “Qualifying Countries” for government procurement's is listed below.
Note: China, Russia, Pakistan and Malaysia are not TAA Qualified.
