Hello Most Valued Members!  We had huge back-to-back events here in September for the BIAOC!  I hope you all enjoyed them. 
  
Our Softball Tournament on Friday, September 14th was a hit!  We had 18 teams and over 250 players!  I would like to congratulate Lennar IE for taking the big win this year.  They played some awesome games and the championship game was definitely a close one with their opponent Matrix Surfaces.  And although I personally didn't win, I still had a great day playing and enjoying the event.  But you all better watch out, next year I am bringing the heat!  A special thank you to the Softball Committee for making this event a huge success.  (Click here to see photos from the event)
 
The following Friday, we had our September General Membership Breakfast Meeting Presented by Best Management Construction, Inc.  The topic was Net Zero Energy and boy did our speakers give us just that.  We had a fantastic panel with Ei Companies (the how), SCE (the why), Sonnen (the what) and Mandalay Homes (the Done!) presenting their strategies on Net Zero.  For those that made it, you have an advantage over those that did not.  Go get 'em!  We also honored   William Lyon Homes  with HomeAid Orange County Lifetime Achievement Award.    Congratulations again to William Lyon Homes and thank you and all builders, trade partners and associate members for your continued contribution and support to HomeAid Orange County.  (Click here to see photos from the event)    
 
Next month we have our BITA Wine Event on Thursday, October 11th.  The proceeds from this event go to our Building Industry Technology Academy (BITA) which trains high school students on the building trades and prepares them for the labor force.  If you have not done so already, I highly encourage you to Sponsor and register and attend this event.  It will be a great night of wine, food, silent auction, and raffle prizes....all going to a great cause!  Help us make a positive impact on our labor shortage and support BITA today!

City of Anaheim
September was a quieter month for the City of Anaheim. BIA/OC continues to watch for a mandatory art fee proposal that has circulated through City Hall. The most recent version of this proposal exempts all residential construction and instead focuses on a 0.5 valuation of commercial projects over 25,000 square feet. 
   
City of Brea
Starting as far back as October of 2017, the City of Brea has been considering an increase to development related fees. The BIA has attended every hearing over the last year to share the cautionary tale of how fees harm development. This is especially relevant at a time when the independent Legislative Analyst's Office cites California's housing woes as a lack of supply.  At the September 18th hearing, the city approved an increase to existing cost recovery. The adopted proposal holds cost recovery near 75% and limits future increases to CPI with comprehensive reviews every ten years.

City of Costa Mesa
For over a year, the City of Costa Mesa has been debating the future of their Small Lot Ordinance. At many times it appeared the Council was headed towards a wholesale repeal of the policy as it fit the 'no-density, no-growth' narrative pursued by some.
 
Through hard work and tireless resolve, the BIA is happy to announce the final hearing on the matter occurred September 4th and the Small Lot Ordinance remains in Costa Mesa. BIA was instrumental in sharing information and demonstrating how the Ordinance enhances homeownership opportunity in an increasingly challenging market. Revisions were adopted at the September hearing that will complicate the success of the policy but the BIA remains resolved to maximize the potential of the Ordinance as a means of expanding homeownership.
 
County of Orange
As previously reported, the County of Orange is pursuing a comprehensive zoning code update, known as Orange to Green.  Part of this update includes a Tree Preservation Ordinance that will directly impact development opportunity on County land.  Through BIA's efforts, the Ordinance has been limited to the Silverado-Modjeska Specific Plan but still contain onerous requirements on development.  Worst of all, no inventory of trees covered by the Ordinance exists so the cost of enacting the language is incalculable.  A date for the next hearing has not been set.

Irvine Unified School District
On October 3rd the Irvine Unified School District will be considering a six-cent per square foot increase on construction costs, in line with the recommendation from the recently completed School Facilities Needs Analysis.

City of Newport Beach  
As reported, the City of Newport Beach voted for an increase in their fire/life safety fee structure. This increase will have a delayed implementation so that the development community has time to adjust to the new numbers. Further, in October, the City is considering
a proposal that would ban contractor construction projects on weekends. While it will not apply to large scale development projects or any project with a development agreement, the BIA will continue to monitor for updates.  
 
City of Tustin
With a process that started in February of 2018, Tustin has continuously pushed for Inclusionary Zoning. The BIA had been successful in delaying implementation of this harmful policy but on Saturday August 11th at 8am the Council met and approved a convoluted policy.
 
Despite lengthy negotiations and nearly reaching an agreement that would remove industry opposition, the City of Tustin instead voted on a policy that requires 5% on-site construction of Very Low-Income Housing, or 10% Low Income Housing but also this construction can be done offsite. Additionally, there is a requirement of a $12,000 per door in-lieu fee on 50% of the total units created on top of the "on-site" construction requirement. The real-world applicability of this ordinance remains questionable, but Council and staff refused alternatives.
 
As such, on September 4th, Council voted 3-2, to approve the final reading of the Ordinance, having it take effect in October.
 
Next, and on a much happier note, the City of Tustin's Planning Commission approved the Red Hill Avenue Specific Plan on September 25th. Within the Specific Plan, 500 new dwelling units will be authorized as an augmentation to the City. It is exciting to see Tustin working to increase housing supply via increased opportunity, despite the actions taken on Inclusionary Zoning. The Red Hill Plan now moves to the City Council for final authorization.
