SECURE ACT Sets a 10-year Disbursement Cap on Inherited IRAs
Consider Making All Saints a Beneficiary and
Avoid Undue Tax Burden on Descendants

On December 20, 2019, the Setting Every Community Up for Retirement Enhancement Act of 2019 (the "SECURE Act") was signed into law. This legislation is the first significant retirement benefit legislation in more than a decade, and certain provisions will have an immediate impact on retirement plans. One such provision that may affect donors is the Modified RMD Rules upon Death of Participant: The SECURE Act modifies the rules relating to the timing of distributions from defined contribution plans and IRA accounts after the death of the employee or account owner. Specifically, subject to the rules described in the Act, distributions are required to be completed within 10 years of the death of the employee or account owner, eliminating the lifetime Stretch IRA. This may cause an undue tax burden on descendants, making charitable contributions more attractive. To see an article about the Act, click HERE.

Consider becoming a Legacy Society member today by naming All Saints as a beneficiary of a defined contribution plan or IRA account. Or consider setting up a Charitable Trust and Charitable Gift Annuity funded by the remaining IRA as an effective tax option to gift beneficiaries with retirement funds without taxation or the required 10-year distribution rules. See our brochure of options HERE. To discuss how you can help leave a legacy, contact Alyssa McBride at [email protected] or 804.329.7524 x 111.
