Can Employees Decline FMLA Leave While Using Paid Time Off?

DOL opinion letter says no, but an appellate court ruled otherwise

By Lisa Nagele-Piazza, J.D., SHRM-SCP

Once an employer knows that a leave of absence qualifies under the Family and Medical Leave Act (FMLA), it must designate it as such, even if the employee wants to first exhaust paid-time-off benefits.

The U.S. Department of Labor (DOL) took this position in a recent opinion letter, though its opinion conflicts with a federal appellate court ruling.

Hiring People with Criminal Backgrounds Is Easier Than You Think

By Roy Maurer

Second-chance hiring-recruiting and hiring people with criminal backgrounds and eliminating obstacles to those efforts-is building momentum among policymakers, say business community leaders and worker advocates.

Genevieve Martin, executive director of Dave's Killer Bread Foundation, a prominent voice in the second-chance movement, told attendees at the 2019 Society for Human Resource Management Employment Law & Legislative Conference March 18 in Washington, D.C., that hiring people with felony convictions shouldn't be a "big, scary thing."

SSN No-Match Letters Return

After seven-year hiatus, Social Security Administration is again notifying employers when W-2 records don't match employee Social Security numbers

By Allen Smith, J.D.

For the first time in seven years, employers are receiving Social Security number (SSN) no-match letters from the Social Security Administration when it has discovered that the W-2 records submitted by the employer don't match the administration's records on employee names and SSNs. This is a warning to employers to carefully check the employee's information. The problem could be as innocent as a typo or as serious as a stolen identity.

Format
Meeting Format - Changes in 2019!
Our members have told us that it is getting much harder to break away from the office in the middle of the day for Chapter meetings, especially with the traffic. While we have many members who work in the Kent/Renton/Auburn area, many others work downtown or on the east side so mid-day meetings are impractical for them to attend even if they live in the south end. Other SHRM Chapters have told us traffic is creating similar problems for their members.
Since one of our goals is to provide meaningful education to our members, to accomplish that we have decided to offer a mix of in-person breakfast meetings (accessible to all who live or work in the south end!) and webinars.
  • All meetings will be on Wednesdays
  • In-person meetings will be at Centerpoint in Kent (same as always!), with breakfast starting at 7:15am and presentations starting at 8:00am and ending at either 9:00am or 9:30am
  • Webinars, which will be free to South King County SHRM members, will be 12:00pm-1:00pm
Why are we moving to Wednesdays? Other Chapters in the area have their meetings on Tuesdays or Thursdays, so moving to Wednesdays avoids conflicts for those who wish to attend multiple meetings.
We expect to have our complete 2019 Chapter Meeting Schedule posted on our website by mid-February. We hope to see you soon!
Fees
2019 Meeting Fees and Annual Passes

We have continued to face increasing prices from our venue and catering providers. This is no surprise given the changes in minimum wage, taxes, and general economic costs in our area.

As a Chapter, we want to continue to offer programs that are valuable and affordable. Introducing webinars not only introduces convenience, but also is a benefit we can offer free to members to help control overall annual costs for individuals.

This year we are also introducing an Annual Pass available only to South King County SHRM Chapter members. Annual Pass holders must still register for monthly offerings, but the all-inclusive price offers a significant savings (at least 15%-20%!).

Individual Chapter Meeting (we will have 5, perhaps 6 breakfast meetings in 2019)
  • SKC SHRM Member                     $45
  • Non-SKC SHRM member             $55
  • Late (members & non)                  $60

Webinars
  • SKC SHRM Member                    Free!
  • Non-SKC SHRM member             $19.95

We are very pleased to be able to offer our members an entire year's worth of education, recertification credits and networking for only $250! This year, we will take our meeting hiatus in December, so will have programs the other 11 months.

You can purchase your Annual Pass via the January meeting registration link. After purchasing, you will be provided with a Pass code you can use to register in future months.
