Times change. People change. And that happened at TSS in the past month. Jo McGuire, senior project manager, has taken on a new role as Executive Director for the
National Drug and Alcohol Screening Association. It's not really "goodbye," it's more of a "see you soon" feeling. As TSS is a founding member of that association and Jo the first chair, our relationship carries on, just in a different manner. We'll continue to work together on national projects that matter to our clients. It will just be a bit different. We wish Jo well in her next adventure with NDASA. And we'll see her soon in her new capacity.

presented on the new Commercial Driver's License Drug and Alcohol Clearinghouse that the agency is launching on Jan 6, 2020. Registration for the Clearinghouse will open in the fall of 2019.
What does this mean for you? A LOT. There are many changes coming and you will want to know about them ahead of time, not when you are trying to hire in a hurry. We've got the skinny.
Currently, employees who fail or refuse a drug screen are required to report this to their next employer. Employers are supposed to perform the drug and alcohol history background checks on every driver they hire. The system is designed to stop a driver with a drug habit from jumping from one company to another, without going through the required Substance Abuse Professional process.
The FMCSA Clearinghouse is an electronic database that will keep those drug and alcohol program violation records in one place for employers to review prior to hiring. The secure database will be reported into by Medical Review Officers (MRO) and employers. Users will be required to register for the Clearinghouse for designated uses. Drivers will also be able to (and should) register to view their own information.
How will this increase safety on our roads?
The database will provide REAL-TIME access to violation information, all across the nation. Employers will have drug and alcohol history in minutes, instead of hoping that a former employer will provide this information in a timely manner. It will become more difficult for drivers to conceal violations from employers. Moreover, the Clearinghouse will provide more insight into how employers are complying with drug and alcohol testing rules.
Currently, FMCSA is in the information phase of the project doing presentations, soft launching of the program and allowing users to register for progress updates. In October, FMCSA expects to open the registration process for the creation of user accounts. MANDATORY reporting will begin on January 6, 2020. You will, however, still need to use your manual system of asking former employers for driver history. WHY? Because federal regulation says you need to acquire about three years of history. The database won't have the full three years for ... you guessed it, three years. So, for a period of time, you will need to do both. Starting in 2023, the system will become fully electronic.
Who will use the Clearinghouse?
- Drivers who hold CDL's or CDL learner permits.
- Employers of CDL drivers who operate CMV's.
- Consortia/TPA's. That's TSS, Inc for most of you.
- Medical Review Officers
- Substance Abuse Professionals
- State Drivers Licensing Agencies
Those are all the folks who will have access to the Clearinghouse to check on a driver's drug and alcohol history. This a serious business and will be a learning curve for many. In the coming weeks, we'll take a deeper dive into various aspects of the Clearinghouse.
