Latest Nursing Home Staffing Data Available from 
the Long Term Care Community Coalition

Long Term Care Community Coalition (LTCCC), an advocacy organization whose work is grounded in its organization as a New York State based coalition of consumer, community, civic and professional organizations,  has published their latest data on nursing home staffing.  

The data provides information on staff assigned to provide resident care and select non-nursing staff, including those providing important activities and social work services. This information is available by city and county.

Governor Phil Murphy Signs New Law 
Allowing Out-of-State Licenses  To Be Used in New Jersey

On Friday, August 10, Governor Phil Murphy signed legislation sponsored by Sen. Tom Kean, Jr. (LD-21) and Assemblyman Andrew Zwicker (LD-16) that recognizes the professional licenses of displaced Puerto Rican doctors, nurses, teachers and other professionals who relocated to New Jersey following Hurricane Maria.  

The new law revises the section of state law involving the reciprocity process of out-of-state professional and occupational licensing.   Currently, licensed professionals from jurisdictions with standards that are substantially equivalent to New Jersey's may work in their respective industries in the state provided they supply the state with proof that an out-of-state license is valid, current and in good standing.  

Under the new law, verification of licensure must be submitted to the appropriate state licensing board within six months or, in the cases of individuals relocating due to a natural disaster or other catastrophic event, will have one year from the bill's August 10, 2018 signing to provide the required documentation necessary to ensure the applicant's license can be used when they relocate to New Jersey.  
Governor Phil Murphy Signs New Law 
Concerning Continuing Care Retirement Communities 

On Friday, August 17, Governor Phil Murphy signed legislation sponsored by Sen. Kip Bateman (LD-16) and Assemblyman Eric Houghtaling (LD-11) that expedites the process for entrance fee refunds for seniors leaving a continuing care retirement community (CCRC).  

The new law will limit the time a CCRC can retain a refundable entrance fee after a resident leaves the facility.  A resident or the estate must provide written notice once the unit has been vacated and personal items removed.  The facility may then restore the unit to its original condition and remove any personal property left in the unit after 21 days.  Within 60 days, the resident or resident's estate will be given a number and placed on a list in sequential order.  Upon the sale of the unit, the resident or resident's estate  will receive their refund based on their position on the list. 

The law goes into effective November 15 and applies only to CCRC agreements entered into on or after November 15.  
New Jersey Department of Labor and Workforce Development
Releases Guidance and Forms Regarding Equal Pay Protections

The New Jersey Department of Labor and Workforce Development (DOLWD) released guidance and forms in relation to the Diane B. Allen Equal Pay Act. 

On April 24, 2018, Governor Phil Murphy signed into law New Jersey's Diane B. Allen Equal Pay Act. The law provides that, effective July 1, 2018, any employer entering into a contract with the State of New Jersey or an instrumentality of the state for "qualifying services" or "public work" must provide to the DOLWD wage and demographic data for its employees.

Diagnosing and Investigating Legionnaires' Disease Cases

Although Legionnaires' disease is diagnosed year-round, providers are reminded to have a high index of suspicion during the summer and early fall, as the incidence usually increases during these seasons.

Legionnaires' disease cannot be distinguished form other causes of pneumonia based on clinical or radiologic examination.  Healthcare providers should consider Legionella when evaluating patients for community-acquired and hospital-acquired pneumonia. 

All suspected or confirmed cases of legionellosis (Legionnaires' disease and Pontiac fever) should be promptly reported to the local health department where the patient resides.  Contact information is available at: localhealth.nj.gov
