Client Alert: Oregon Update

Last summer, Oregon passed Senate Bill 726 (also known as the Oregon Workplace Fairness Act), which expanded employers’ obligations to prevent discrimination and sexual assault and changed the legal landscape for employers in the state by:

  1. Increasing the statute of limitations for several discrimination claims from one year to five years;
  2. Requiring employers to adopt anti-discrimination policies with detailed information required by the new law; and
  3. Restricting non-disclosure, non-disparagement, and no-rehire provisions in certain severance, separation, and settlement agreements.
