SHTA: " Pennywise and Pound Foolish "

The St. Maarten Hospitality & Trade Association (SHTA) has taken note of the announcement by VROMI Minister Giterson to re-evaluate the day time road work schedule after bringing the country to its knees for two days, the SHTA said in a press statement on Thursday.

“Literally to a crawling stand still with hours of lost time to countless citizens and businesses; simply to save on night time differential wage tariffs.

“It is high time the powers that be learn from past experience as this is not the first time such an attempt at savings has occurred with exactly the same results.  Government should understand the value of productivity and take into consideration the irreparable cost of lost productivity in any cost analysis.

“In infrastructure, it is never as simple as how many bills do I have to pay now; there is always the coefficient of how much improvement do I get over how long and when do I regain the cost of my investment.  

“It would be even better, if the various ministries cease operating as independent silos and start working together on planning and coordinating, so that before a decision like this is taken consultation should be held among VROMI and TEATT and determine the economic and social impact of such decision, for example.

“If our government do not begin to appreciate that the citizens of this country also have value, that their time is money and that we as a country need to put our best foot forward to our visitors if we want to regain any market share, in our ever-shrinking economic condition; we fear they will find they are only in control of a welfare state without any possibility of economic prosperity.”

7-parts series about the Public Prosecutor's Office views on the lead times of investigations
This is a special report brought to you by StMaartenNews.com outlining the views of the Public Prosecutor's Office on the statutes of limitations pertaining to the length of investigations, in particular those of politicians, other public figures and prominent citizens on St. Maarten.

Here is a recap of parts 1 through 7:

In part 1 we discussed the Public Prosecutor's Office and its workings.

In part 2 we discussed how the Public Prosecutor's Office conducts investigations.

In part 3 we discussed that the Public Prosecutor's Office does not work alone when it comes to investigating and bringing criminal cases to trial. It is a part of the criminal justice chain system and each link depends on the other to execute its work properly. So delays on the front-end can have a domino effect on the lead time of a criminal case before judgement is finally executed.

However, the Public Prosecutor's Office has the so-called prosecution monopoly. This means that only the Public Prosecutor can prosecute criminal cases and bring them to court. Individual citizens can not do this. They can file a complaint with the police. Based on an investigation, the OM then decides on prosecution. If the complainant or interested party disagrees with the OM's decision not to prosecute, the interested party concerned can complain to the court. The latter is not very common.

In part 4 we discussed the length of investigations carried out by the Public Prosecutor's Office. Specifically, we wanted to know how long does this actually take in St. Maarten? Unfortunately, no hard data into the lead times of the criminal justice chain exists on St. Maarten.

In part 5 we questioned whether it is allowed for investigations to last so long, whether the so-called "statutes of limitations" exist and are applicable and who checks and oversees this.

In part 6 we discussed the question whether prosecutor-led investigations can't be dealt with faster. The Prosecutor's Office indicated that it always strives to expedite investigations, but that the speed was partly dependent on the capacity of the police force, which is heavily understaffed. The explanation concluded that they are working on an improved registration process to gain insight into the turnaround times. The starting point is modernizing the working methods, modernizing the laws and implementing the use of various instruments to improve effectiveness and efficiency.

In the final part 7 we discussed the question whether the situation surrounding investigations and the length thereof on St. Maarten is the same as in The Netherlands. In principle, the Public Prosecutor's Office stated for the record that in terms of execution and the lengths of investigations there is no difference between the situation in the Netherlands and St. Maarten, even the debates on the duration and speed are the same.
