Irvine Raises the Pride Flag at City Hall!


Irvine, CA -- The Irvine City Council voted 4-1 on June 23, 2020, to fly the LGBTQ pride flag at City Hall every June, with Mayor Christina Shea being the only dissenting vote.

The flag will be flown from Harvey Milk Day on May 22 through the end of June.

"The LGBTQ+ community has fought for many years for equal rights under the law," said Fox, who introduced Tuesday's item with Councilwoman Farrah Khan. "In many places in other communities, they're still facing hatred, violence and discrimination. But in our community in Irvine, this is a safe place, a place of acceptance and a place of equality. And I believe that we should be proclaiming that."

Even though this motion failed to get approval when she brought it to the Irvine City Council last year, Councilmember Melissa Fox refused to give up. " As Harvey Milk told us," Fox said, "Hope will never be silent."

Councilmember Farrah Khan stated, " City Hall stands as a representation that Local Government works for EVERYONE, not just a few. As an ally who over the past year has worked hard to listen and hear from our LGBTQ community. I know the pride flag is more than just  a flag -- it was created to symbolize hope, opportunity, and prosperity. There is no better place to showcase that message than right here at our own City Hall." 



The Irvine City Council has repeatedly demanded MORE information and transparency on the effects of COVID-19 from the County, now they are providing even less!

Where are there outbreaks?
Which communities are hardest hit?
Where are the most deaths occurring?
Where should we be increasing testing?

When there is an outbreak in an Orange County nursing home, that goes unrecorded because patients will have an official residence elsewhere, and the nurses who became ill are also unrecorded for the  same reason. The same  issue is present with OCTA drivers, restaurant workers, grocery clerks, and janitors. If they live elsewhere, when they get sick from COVID-19 while working in Orange County, their illness or death will not be attributed to Orange County.

Anaheim officials were told by Orange County officials to keep secret COVID-19 data that shows how badly it has hit parts of that city. Have they done the same in Irvine? Orange? Tustin? Lake Forest?  In your city?

Orange County residents and city officials need this information!

There were 26 deaths reported from COVID-19 in Orange County in just one day last week. 

The brute fact is that this pandemic is not on the decline in Orange County, but is on the rise.

Despite this fact, it remains unclear how or even if the statewide coronavirus mask mandate will be enforced in Orange County , after County Supervisors declined to address any enforcement approach, ignoring the scientific consensus that face covering is the best weapon we now have against this virus, Ignoring the numerous residents advocating for it, and ignoring the fact that our infections and deaths from COVID-19 are steadily increasing.

As the  Voice of OC reports, "Throughout the pandemic, OC officials haven't strictly enforced business closures on restaurants and bars.  And OC Sheriff Don Barnes said he wouldn't enforce former health officer Dr. Nichole Quick's mandatory mask order, which was issued over Memorial Day weekend as diners and shopping centers reopened."

As a result of the Board of Supervisors' failure to follow state-mandated guidelines for stopping the spread of COVID-19, including enforcement of the state's mask wearing order,   Orange County is in grave danger of losing out on our share of a proposed $2.5 billion state bailout package.

Orange County residents and businesses desperately need this financial relief!

The infuriating truth is that the catastrophic failure of leadership in Orange County regarding COVID-19 has mirrored - and is the best direct result of - the catastrophic failure of leadership in the White House.

Like the White House, Orange County needs to stop ignoring science, and stop playing games with the numbers, the facts, and our lives!

Democrats Unify to Form "Team Irvine" Slate in Races for State Assembly District 68, Irvine Mayor, and Irvine City Council!


IRVINE, CA - Four local Democratic campaigns have announced the formation of a unity slate called "Team Irvine" in the upcoming November 2020 elections for California State Assembly District 68, Irvine Mayor, and two open seats on the Irvine City Council.


The four campaigns comprising "Team Irvine" are Melissa Fox for California Assembly District 68, Farrah N. Khan for Irvine Mayor, and Tammy Kim and Lauren Johnson-Norris for Irvine City Council. Currently, Melissa Fox and Farrah N. Khan are Irvine City Councilmembers, and Tammy Kim and Lauren Johnson-Norris are Irvine City Commissioners.

The group also released the following joint statement with their announcement:

"As Orange County Democrats, we know the hard work that goes into Democrats elected. The past few years have seen incredible gains, including electing an entirely Democratic congressional delegation, turning Orange County blue with registered voters, and nominating more women and people of color to run for the California Assembly and Senate. We cannot let that energy fade in November. We must ensure that our Blue Wave reaches every local office, including Irvine. That's why we are setting the bar for other Democrats and joining forces with one goal in mind -- ensuring that we elect Democrats to office in Irvine and across Orange County. We need each other to win."

Tell the Irvine City Council To Repeal Its Cruel 
and Unconstitutional Anti-LGBTQ Law!

Please join us on July 14, 2020, when the Irvine City Council decides whether to approve the motion from Councilmembers Melissa Fox and Farrah N. Khan to repeal and remove a cruel and unconstitutional anti-LGBTQ ordinance that has been part of Irvine's Municipal Code as Sec. 3-5-501 through 503 since 1989.

Most residents of Irvine do not know that our diverse and forward-thinking city has an ordinance on the books that specifically and explicitly denies anti-discrimination protection to people based on their sexual orientation.

In fact, most residents are shocked when they learn that the Irvine Municipal Code includes the following:

"Sec. 3-5-503. - City Council parameters.
Except as provided in section 3-5-502, the City Council shall not enact any City policy, law or ordinance that:
A.  Defines sexual orientation as a fundamental human right.
B.  Uses sexual orientation, in whole or in part, as the basis for determining an unlawful discriminatory practice and/or establishes a penalty or civil remedy for such practice.
C.  Provides preferential treatment or affirmative action for any person on the basis of their sexual orientation."

It is outrageous that this cruel and unconstitutional law is still on the books in Irvine! It's long past time for it to be repealed and removed!

These provisions were added by Ord. No. 89-1, which was adopted as Measure N by 53% of the voters as an initiative on Nov. 7, 1989, overturning an Irvine Human Rights Ordinance enacted by the Council in July 1988 that prohibited discrimination based on sexual orientation.

The main proponent of the Measure N ballot initiative and the subsequent anti-LGBTQ ordinance was a group calling itself the " Irvine Values Coalition" led by carwash-developer  Michael Shea and his then-wife (and later Irvine mayor) Christina Shea.

According to Christina Shea, the initiative was needed because the earlier Human Rights ordinance gave "special legislative protection to the homosexual, bisexual and lesbian communities" and "homosexuality is characterized by a wide range of sexual perversions, varying degrees of promiscuity and a disproportionate percentage of sexually transmitted diseases."

This anti-LGBTQ ordinance violates both the Equal Protection Clause of the United States Constitution and California's Unruh Civil Rights Act.

In  Romer v. Evans, 517 U.S. 620 (1996), the U.S. Supreme Court ruled that the Equal Protection Clause of the Constitution prohibits a state from banning LGBTQ people from seeking "specific legal protection from injuries caused by discrimination."

The facts of Romer v. Evans are as follows: after various cities and counties in Colorado enacted laws prohibiting discrimination based on sexual orientation, the State of Colorado, through a ballot initiative, amended its state constitution to "prohibit[] all legislative, executive or judicial action at any level of state or local government designed to protect . . . homosexual persons or gays and lesbians." As the Supreme Court explained, under the amendment, "Homosexuals, by state decree, are put in a solitary class with respect to transactions and relations in both the private and governmental spheres. The amendment withdraws from homosexuals, but no others, specific legal protection from the injuries caused by discrimination, and it forbids reinstatement of these laws and policies."

The Supreme Court declared that the Colorado constitutional amendment was based upon animosity toward homosexual people and lacked a rational relation to any legitimate governmental purpose.  Accordingly, the Court determined that Colorado's constitutional amendment violated the Equal Protection Clause of the 5th Amendment of the U.S. Constitution, applicable to the states through the 14th Amendment.

Like the Colorado constitutional amendment that the Supreme Court invalidated in Romer v. Evans, Irvine's anti-LGBTQ ordinance attempts to prohibit local government action "designed to protect . . . homosexual persons or gays and lesbians" [i.e., protects people based on "sexual orientation."] and like the Colorado constitutional amendment invalidated in Romer v. Evans, Irvine's anti-LGBTQ ordinance "withdraws from homosexuals, but no others, specific legal protection from the injuries caused by discrimination." Accordingly, Romer v. Evans renders Irvine's anti-LGBTQ ordinance unconstitutional. 

Moreover, not only is Irvine's anti-LGBTQ ordinance unconstitutional, it also clearly contradicts and is superseded by California's  Unruh Civil Rights Act, which explicitly prohibits discrimination against people based on "sexual orientation." Because state law supersedes any city law or local ordinance, the Unruh Civil Rights Act's prohibition of discrimination on the basis of sexual orientation anywhere in California means that Irvine lacks the power to declare that "the City Council shall not enact any City policy, law or ordinance that: Uses sexual orientation, in whole or in part, as the basis for determining an unlawful discriminatory practice and/or establishes a penalty or civil remedy for such practice."

Councilmember Farrah Khan and I would like the see the eyes of the world on Irvine. We believe that the three others on the Irvine City Council - Mayor Christina Shea and Councilmembers Anthony Kuo and Mike Carroll - are far more likely to vote to repeal and remove this cruel and unconstitutional ordinance from the Municipal Code if they know that PEOPLE EVERYWHERE ARE WATCHING!

You can read more about the origins of this anti-LGBTQ ordinance - how it was promoted by (now Mayor) Christina Shea and her then-husband Michael Shea out of animosity and fear toward LBGTQ people and as a launching pad for their right-wing political careers - at Melissa Fox's blog post HERE.

The Irvine City Attorney, who is an ally of Mayor Christina Shea, has stated that because this anti-LGBTQ ordinance was made law by a ballot initiative, it can only be repealed and removed by another initiative. Our argument against this assertion is that this ordinance is clearly unconstitutional under many United States Supreme Court cases, as well as in violation of federal and state law; for this reason, it's repeal and removal does not change the law in a way that requires another ballot measure.

In fact, the California Legislature dealt with this very issue in its repeal of the unconstitutional sections of Prop 187 by  Senate Bill 396 (2014) by a majority vote of the Legislature without a vote of the entire electorate.  As the Judicial Committee of the California Senate  noted, "Under existing law, California's Constitution only authorizes the Legislature to amend or repeal initiative statutes by way of another statute that becomes effective only when approved by the electors -unless the initiative statute permits amendment or repeal without their approval. (Cal. Const., art. II, Sec. 10, subd. (c).) This bill [SB 396] seeks to repeal several state statutes implemented upon voter approval of Proposition 187, which generally prohibited the provision of various benefits to undocumented aliens. That proposition did not authorize the Legislature to amend or repeal its provisions without voter approval."

Nevertheless, the Judicial Committee found that the Legislature had authority to repeal the unconstitutional sections of Prop 187 without a vote of the entire electorate. It reasoned that because the bill did not modify or repeal any provisions of Prop 187 except those that are unconstitutional and therefore unenforceable, it did not make any change in existing law. Accordingly, "SB 396 would not impermissibly repeal or amend the initiative; rather, it would merely update California statutes to accurately reflect current law." The bill passed the Assembly and the Senate with  only a single No vote.


The same circumstances exist here. Keeping this discriminatory language on the books, "causes confusion and harmful outcomes . . . [Therefore], it is fitting that [we] expressly acknowledge the detrimental impact of the discriminatory [language] by removing its stain from the state's statutes."  That is precisely what our City Council needs to do now, and what the precedent of SB 396 gives us clear authority to do: "expressly acknowledge the detrimental impact of the discriminatory [language of Sec. 3-5.501-503] by removing its stain from the [City's Code.]"

In addition to being unconstitutional and in violation of superseding state laws, Irvine's anti-LGBTQ ordinance is a cruel and embarrassing relic of a more prejudiced time.

Does Irvine want to remain on record as being one of the very few cities in America, and  indeed the world, that still officially discriminates against people based on their sexual orientation?  We hope not!

Free Summer Concerts and Movies for Irvine Residents! 


E njoy movies and concerts in the park - with a twist - during the Irvine Summer Drive-In Series. This series of modified events brings the community together while safely following social distance guidelines. 

The Summer Drive-In Series features movies on the big screen and live concerts to the Orange County Great Park in drive-in format every Saturday this August. Park your cars, bring a picnic basket, or plan to purchase treats from gourmet food trucks.

The drive-in will be set up in parking lot 2 at the Great Park.

Movie gates open at 6:45 p.m. and movies begin after sunset, approximately 8:15 p.m.
Concert gates open at 4:30 p.m. and start at 5:30 p.m.
Guests will be able to listen through amplified sound or tune in through their car radios via a special FM station for the events.
Space for this special event is limited, and guests must register in advance.

I was happy to participate in Mad Engine's drive-up mask giveaway in Irvine.

The mask giveaway is part of Mad Engine's GoodWorks initiative, which has donated hundreds of thousands of fabric mask to many organizations such as City of Hope, CHOC, Scripps, Union Rescue Mission and other organizations in need of masks.

Faizan Hanif Bakali, President/COO of Mad Engine has said, "We understand many families in our local community are in need of non-medical fabric masks but have  no access to them. We want to help."

Help Families Forward Food & School Supply Collection Event!


The City of Irvine is supporting a volunteer-driven food and school supply collection event benefiting Families Forward . This "Irvine Neighbors Helping Irvine Neighbors" drive-through food collection event will be held Saturday, July 11 from 9 a.m. to noon.

This is a drop-and-go event; all food items need to be placed in the
trunk of your vehicle.

Drive-Thru Farmer's Market at Orange County Great Park Remains Open on Sundays! 


I worked with City of Irvine staff and the coordinator for the Great Park Farmer's Market to develop a Drive-Thru Farmer's Market for Sundays, from 10:00 a.m. to 2:00 p.m.

I've always loved farmer's markets, and I'm glad I was able to help provide fresh food to our community when it's never been more important to eat right to stay healthy!

The Sunday Drive-Thru Farmer's Market at the Great Park allows for the market to be open during the COVID19 outbreak while maintaining social distancing in keeping with state and federal guidelines will continue until further notice.

At this time, there are approximately 23 vendors scheduled to participate with items varying from fruits and vegetables to hummus, bread, beef jerky, honey, and eggs.
A traffic safety plan has been developed with the assistance of Public Works & Transportation, Public Safety, and Community Services staff to facilitate anticipated traffic.

The Market is staffed with uniformed police officers in marked vehicles to assist in traffic flow and to ensure social distancing is adhered to. Community Services will also have three staff on-site beginning at 6 a.m. to facilitate the vendors or provide additional assistance as needed.

Admission is free. The Farmers Market is located in Lot No. 2; enter along Great Park Boulevard at Sand Canyon Avenue.

Here is some important information:
  • Drive-thru only. No walk-ups or cyclists will be served.
  • Exact cash is required, if using cash. Venmo and bank cards will be accepted.
  • Purchase only what is needed, be considerate of others in need.
  • Be patient and proceed slowly when waiting in traffic.
  • Wash all produce before consumption.

All Californians should check in on their older neighbors with a call, text or physically-distanced door knock to make sure they're okay during this COVID-19 outbreak and stay-at-home order.

Our campaign - Melissa Fox for California Assembly (AD68) - has decided to use our phone-banking and community outreach resources to call seniors and people in need of critical services in the cities of Assembly District 68 - Lake Forest, Tustin, Orange, Irvine, Anaheim Hills and Villa Park - to ask how they're doing during this stressful time and to see whether they need any help, including food assistance and mental health assistance and other community resources.  

Our volunteer callers will be able to provide information and connect seniors with any community assistance or resources they might need.

Multiple Irvine Police Department vehicles and motorcycles were damaged when the Irvine Police  supported the local police during a protest march in Santa Ana. In response, the South Coast Chinese Culture Center/Irvine Chinese School launched a donation drive in the Chinese community to help repair Irvine's police vehicles. At the Irvine City Council meeting on June 23, 2020, the S outh Coast Chinese Culture Center/ Irvine Chinese School presented a check for $15,000 to the Irvine Police Department.

Lottery for Irvine Community Land Trust 
Salerno Apartments Closing July 15th!


I am proud to serve as Chair of the Irvine Community Land Trust, fighting for and building affordable housing.

The lottery for the Irvine Community Land Trust's newest affordable apartment community, Salerno, is closing on July 15th at 5:00 p.m.

Salerno is currently under construction, with construction expected to be completed in January 2021 and an estimated to have move-in dates in the first quarter of 2021.

Anyone interested in a Salerno home must register before the lottery closes.

The lottery is not on a first-come, first serve basis. Names will be drawn once the lottery registration has closed from everyone who has registered for the lottery. The Irvine Company has issued a statement regarding deferring rent for their retail companies. Starting on April 1, 2020 the Irvine Company will be deferring rent at retail properties for 90 days. Deferred rent will be paid back over a 12-month period with no interest commencing on January 1, 2021.

  Unemployment Benefits (California):

Individuals who have had hours reduced or their employer has shut down have the option to file an Unemployment Insurance (UI) claim through EDD. UI will provide workers who have lost their jobs or have had their hours reduced with partial wage replacement benefit (applies only to those who have lost their employment or had hours reduced through no fault of their own). Individuals may also be eligible for UI benefits if their child's school has closed and they must miss work to care for them. Eligibility considerations include whether or not individuals have other care options and if you are unable to continue working normal hours remotely. 

Disability Insurance (California):

Individuals who are unable to work due to having or being exposed to COVID-19 (must be certified by a medical professional), may file a Disability Insurance (DI) claim. DI provides short-term benefit payments that amount to approximately 60-70 percent of wages (depending on income).
