The Musical

In giving the invocation at our May Law Day meeting, U.S. Air Force Academy graduate Jack Janecky referred to our inalienable rights of life, liberty, and the pursuit of happiness, and I was reminded of these lines from the musical 1776. I watch the movie version every Fourth of July. The story is based on the events surrounding the signing of the Declaration of Independence. Having graduated from high school in 1976, it was a staple of my youth, and performed locally by one of our award winning playhouses. I still remember being so impressed by the booming and beautiful baritone voice of South Carolina delegate, Edward Rutledge, played by our own Calvin Clay. Oh, I know, there are numerous historical inaccuracies in the play (Adams was not as disliked as they make him out to be, there was no southern delegate walkout over slavery, the terms “right” and “left” referring to political parties had not even been invented yet, etc., etc.) but the point is this – both Jefferson and Adams were correct: Americans enjoy certain rights that can never, ever, be taken away. Those rights are so important that many Americans, including many members of the MBA, have been willing to fight and risk death for them. Men like the aforementioned Jack Janecky, who flew re-fueling missions in Vietnam; Bobo Cunningham, who flew over 300 combat missions in Vietnam before being wounded in the 1968 Tet offensive; Tom Galloway, Sr. and Herndon Inge, who were captured by the Nazis in World War II; Suntrease Williams-Maynard who carries the rank of Captain in the U.S. Air Force Reserves; Judge Jim Patterson, who flew Navy helicopters during the Cold War and Middle East engagements; and Judge Jeff Beaverstock, who served four years as an airborne ranger infantry officer in the U.S. Army, and so many more who, due to space limitations, are not mentioned here.
Since the birth of our country, lawyers have always led the way. Of the 56 signers of the Declaration, almost half were lawyers who pledged their “lives, fortunes, and sacred honor” to protect our inalienable rights.
Over this holiday weekend, please be safe, enjoy your family, and think about the pledge these lawyers took and whether we would be willing to do the same today.
And, if you have time, maybe take in a play.

I hope you are enjoying this hot and steamy summer. We at the Bar headquarters are preparing for the remainder of 2019 and even looking ahead into 2020. The Mobile Bar Association is your trade association and is active in promoting professionalism and integrity, providing engaging networking opportunities, and offering the highest standards in continuing education.
Networking is one of the most important benefits for members. The connections made help promote and advance you individually as well as create a spirit of respect and good will within the Mobile legal community.
While networking is important, having and sharing knowledge is central to the Mobile Bar Association’s mission. While continuing education is required to be a lawyer, making the most of the sessions being provided can make you more productive and grow professionally – in knowledge, service and skill. All this combined helps to bring accountability to the Mobile legal community as a whole.
In March, we asked Mobile Bar members to participate in a continuing education survey. Thank you to everyone that participated. We received lots of responses, and it gave us an opportunity to hear your continuing education preferences. Both our CLE committee and various sections are putting your feedback to work to provide you the best CLE schedule for 2019.

2019 MENTORING PROGRAM
Coffee with the Court

The Mentoring Committee is offering a new program for 2019 called
Coffee with the Court
. The concept is to provide a forum for our members to get to know our local judges over a cup of coffee. At each session, two to three judges will present on the topic:
My Top 5 Practice Pointers for Newer Lawyers in my Courtroom
. All participants receive one hour of CLE credit, as well as coffee and bagels. There is no cost for Mobile Bar members with 12 years of experience or less. We welcome all other Mobile Bar members and non-members to join us, and standard CLE rates are charged. Space will be limited. We are asking everyone to register in advance.
We have four more programs in 2019 from 7:30 a.m. to 8:30 a.m. at The Admiral Hotel in the Cove Room. It is a small meeting room on the first floor near the restaurant. Again, we are asking everyone to

In a case of apparent first impression, the Court of Civil Appeals in
Ex parte Avondale Gardens, LP
, No. 2180518 (Ala. Civ. App., May 7, 2019), ruled that the seven-day time period for appealing orders of a district court in the context of an unlawful detainer action under Ala. Code § 6-6-350 governed over the 14-day appeal periods provided generally for appeals from district courts under Ala. Code §12-12-70.
In a case of first impression, the Supreme Court in
Ex parte Russell County Community Hospital, LLC
, No. 1180204 (Ala., May 17, 2019), held that computer software constituted “tangible personal property” for purposes of the state’s sales tax law.
In
Mays v. Trinity Property Consultants, LLC
, No. 2170591 (Ala. Civ. App., May 3, 2019), the Court of Civil Appeals held that under Alabama Uniform Residential Landlord and Tenant Act, posting a notice after one failed attempt at personal service of an eviction complaint failed to constitute a “reasonable effort” to serve notice on the occupant.

In June, SAVLP launched its 2019 Private Bar Campaign. Each year we ask you to support the work we do with a monetary donation. Your contributions help us keep the lights on, but they also enable SAVLP to provide programming and support for our volunteer lawyers and for our clients. SAVLP staff handle client intake, match clients with lawyers, organize CLE training, and provide administrative support for the volunteer lawyers. Staff members offer application assistance at the Mobile County Courthouse, Franklin Primary Health Center, Prodisee Pantry and the United Way of Southwest Alabama’s Grove Hill office. We answer hundreds of phone calls every month, opening cases for those we can help and providing referral information for those we cannot.
The return on your investment with SAVLP is high. In addition to increasing access to the civil legal system for low-income individuals, you are making a significant financial impact on this community. Our latest SROI (social return on investment) estimated that for every $1 invested in SAVLP, the counties we serve received more than $10.00 of immediate and long-term financial benefits. The SROI also calculated that SAVLP’s assistance resulted in $61,648 in immediate direct financial savings for the courts systems and other government operations.
Thanks to your donations, 883 clients received legal assistance in 2018. In the past year SAVLP has helped clients save their homes, family members establish guardianships necessary to provide care, tenants ensure that landlords maintain livable dwellings, and homeless clients address legal issues that serve as barriers to employment and housing. Please consider making a donation to SAVLP so that we can continue to ensure that poverty is not a barrier to quality civil legal assistance. passed away on May 21, 2019. Elizabeth served as the Mobile County Court Administrator during the 1980s and 1990s. She is survived by her husband of 51 years, Rich Pearson, retired circuit court judge of Alabama’s First Judicial Circuit, four children, six grandchildren, and three great-grandchildren. Elizabeth’s son, Martin, is a lawyer in Chatom and her brother-in-law, Beatty Pearson, is a lawyer in Daphne.

passed away on May 20, 2019. Bill was the father-in-law of MBA Member

. Bill received an engineering degree from Yale and an LLB from the University of Virginia. Bill was an attorney with Davis Polk in New York before moving to Mobile in 1966. He worked for Johnstone Adams for 53 years until his death. Bill is survived by his wife Alix, two sons, one daughter, and four grandsons. Bill was tragically predeceased by his son, Frank Hardie, in 2007.

, died on May 19, 2019. Richard is survived by his wife of 52 years, three sons, and seven grandchildren. A banker for 15 years, Richard worked at the Federal Home Loan Bank in Greensboro, NC and American National Bank in Mobile before leaving to begin his career in real estate. He worked for White-Spunner & Associates and then started his own company, Rowan Realty and Development Company. During his career, Richard developed many subdivisions throughout Mobile and Baldwin Counties.

As a reminder, the Archives & History Committee has conducted video interviews over the past five years, and the MBA Executive Committee has placed them on a special YouTube playlist that is accessible on the MBA website by both attorneys and the public.
In 2015, our Committee had the privilege of interviewing John Tyson, Sr., who was 90 years old at the time of the interview. Tyson was admitted to the Mobile Bar Association in 1955 and served in the U.S. Navy as a pilot during World War II and the Korean War. He carried out numerous missions as a pilot and made an emergency landing on an occasion when his plane was seriously damaged by anti-aircraft fire.
Following his return to civilian life, Tyson attended the University of Alabama School of Law and received his law degree. Tyson ran for and was elected to the Alabama House of Representatives and subsequently to the Alabama Senate where he served for many years. He was the chief sponsor of legislation and an active participant in bringing the U.S.S. Alabama Battleship to Mobile as a War Memorial. He served as Chairman of the Alabama Battleship Commission for many years. As an Alabama Senator, he also sponsored the legislation and was one of the founders of the University of South Alabama. He served as a Member of the Board of Trustees of the University of South Alabama for over 10 years. Tyson also served as a Municipal Judge for Bayou la Batre, Citronelle, and Wilmer, and as City Attorney for Dauphin Island and Bayou la Batre. He was selected as the 1997 Mobilian of the Year. Tyson passed away in 2016 at the age of 91. Tyson made great contributions to the forward progress of Mobile County, and we believe his interview is of great interest to our members.

Plans are well underway for the 2019 Tri the Gulf and we need YOU to get involved. Tri the Gulf is a sprint triathlon held on Dauphin Island, Alabama. The course consist of a 600 yard Gulf swim, 16.7 mile island + bridge bike and 3.1 mile island run (short section off road on the golf course). This triathlon is produced by the Mobile Bar Foundation.
There are multiple ways to show your support. First, share the word. Encourage your co-workers, family and friends to get involved. Next, YOU can volunteer, sponsor and/or participate in the race itself.
