We are in the midst of another fabulous year for our industry and our BIAOC! Thank you to all that have contributed your time and energy in making it happen. And with next week being PCBC and many of us up in San Francisco, we decided to do our newsletter a week early to make sure everyone has the chance to see it!
This month HomeAid Orange County held their Builders For Babies event at Angel Stadium. This was actually my first time attending the event and I
was so proud and impressed with everyone's hard work, creativity and contributions. Let's start with the themes and diaper houses - simply amazing! Then on to the spirit and comradery of competitors working together towards a such great cause. It was truly a special day. HomeAid OC raised over 1 million diapers that day and that is all thanks to you! We appreciate all the builders who built and donated diapers, the volunteers, and all of the donations that were made to help families in need. Let's shoot for 2 million diapers next year!
Tomorrow we have our 3rd Annual Crafts & Cars Event at the new Cadence Park. We will have brews featuring: Backstreet Brewery, Cismontane Brewing Co. and Stereo Brewing Company. We will also have two delicious food trucks, BrewWings and Burntzilla. Our NextGen Group will also have a booth set up with corn hole and beer pong. Stop by to play some games and hear more about NextGen and how you can get more involved. I hope to see you all there!

Tustin Inclusionary Zoning
The City of Tustin moved forward with a toned-down version of a relatively aggressive form of Inclusionary Zoning (IZ) this month. The 3-2 vote in favor removed the proposed IZ from the entire City and the Legacy specific plan, and focused the policy on two upcoming Specific Plans yet to be approved after a 2-3 vote to postpone the policy failed. Over the last couple months, BIA/OC Government Affairs has been speaking against the policy, asking for several amendments to reduce the negative impact of the policy. Staff and Council ultimately agreed to grandfathering projects in the pipeline, removing administrative fee language, reviewing the policy after a two-year period, and ultimately leaving the policy on the two upcoming specific plans. Tustin IZ still must go through one more first reading and a second reading before it's finalized.
City of Anaheim
On June 19th BIA/OC was in Anaheim until 1:30 in the morning to battle Inclusionary Zoning and Development Impact Fee increases. Both were on a packed agenda and we are happy to report that the Council voted 4-3 against IZ and postponed consideration of Development Impact Fee increases. These outcomes are great news for the development community as both policies would have had significant impact on development opportunity within the city and cost home builders untold millions. BIA/OC remains engaged and will continue to work with Anaheim on affordability solutions and responsible fee adjustments.
Anaheim is also in the midst of several other issues relating to the development community. It should be noted that there is a movement afoot to impose a 1% project valuation public art fee and Council placed an $18/hr minimum wage (for certain projects) on the November ballot.
City of Costa Mesa
The City of Costa Mesa approved a 54% increase on fees that will impact the development community. This proposal came after staff determined that rates had not been updated in nearly twenty years. BIA/OC fought against these increases and ensured the proposed increase matched only the standard COLA since the last update. Further, BIA/OC secured a grandfathering provision, locking in existing rates for projects submitted prior to September 1, 2018.
City of La Habra
BIA/OC continues to monitor developments in the City of La Habra where a recall petition and 'no-growth' initiative have been filed. The recall is targeted at the City's Mayor, Tim Shaw, also the leading candidate for County Supervisor, District 4. The premise is that he might vote for a development project in the future and therefore should be subject to recall today. The no-growth matter is related to the recall push and targets a golf course within the city that could potentially be used for housing. Papers were filed with the city on the May 29th so the clock starts running on the needed 2,400 approximate signatures for the no-growth and the 5,000 approximate signatures needed for the recall.
County of Orange
The County needs to hear from you on a proposed Tree Preservation Ordinance. As currently drafted, multiple species of trees will receive protections that require significant mitigation efforts for anyone looking to do work on County land. The comment period for this provision is open now and it is imperative that the County hear from the development community on the potential harms this will cause on future housing.

City of Santa Ana
Although in the early stages, rumors persist that Santa Ana is considering alteration to its Housing Opportunity Ordinance, also known as Inclusionary Zoning Ordinance. BIA/OC will closely monitor developments as this story unfolds. There is concern that in-lieu options could be removed and that the existing 15% requirement could be increased. Clearly a cause for concern that will further suppress housing production in that jurisdiction.
June Government Affairs Committee
This month our Government Affairs Committee had several great speakers! First we heard from the Orange County Treasurer & Tax Collector, Shari Freidenrich, on a litany of ways to improve communication with her office and streamline interactions. The tips shared at the meeting can make a significant difference on your projects and her insights were greatly appreciated.
Up next we heard from the County of Orange itself on a major zoning update they are calling Orange to Green. While the update covers a wide range of zoning regulations, the topic receiving the most attention was the Tree Preservation Ordinance. As reported above, the Tree Preservation Ordinance will require developers to hire arborists to identify all tree species on their properties and provide mitigation for specially identified species. As there is no inventory of trees available, this ordinance will create untold new costs on development upon County lands. BIA/OC shared our concerns and will continue to monitor the Orange to Green update as it proceeds.
