Medical Marijuana Legal Update

Mr. Yates's presentation will focus on work place issues associated with legalized marijuana.

James B. Yates represents public and private sector employers in all facets of labor and employment law.  He has achieved the Senior Professional in Human Resources (SPHR) certification.

A member of Eastman & Smith, Mr. Yates's practice encompasses collective bargaining, general personnel planning and counseling, equal employment opportunity matters, workers' compensation and compliance with the Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA) and the Fair Labor Standards Act (FLSA). Mr. Yates has represented employers in labor and employment law related matters with various agencies such as the Industrial Commission, National Labor Relations Board (NLRB), Equal Employment Opportunity Commission (EEOC), Occupational Safety and Health Administration (OSHA), State Employee Retirement Board (SERB), Ohio Civil Rights Commission (OCRC), Ohio Department of Job and Family Services and in state and federal courts and arbitration tribunals. He regularly consults with clients regarding the drafting and implementation of employment policies and conducts supervisor training. Mr. Yates is a frequent speaker at seminars regarding a myriad of labor and employment law topics.

Q:  I had an employee that was stuck by a contaminated needle therefore I sent the employee to a healthcare professional for a post-exposure medical evaluation. What does OSHA require that I provide to the healthcare professional?

A:  OSHA requires the employer to provide the following information to the healthcare professional:  
  • A copy of the OSHA 1910.1030 standard;
  • A description of the employee's duties as they relate to the exposure incident;
  • Documentation of the route(s) and circumstances of the exposure;
  • The results of the source individual's blood testing, if available; and
  • All medical records relevant to the appropriate treatment of the employee, including vaccination status, which are the employer's responsibility to maintain.

FY 19 Safety Council Rebate Program Requirements

The FY 19 Safety Council Program year began 7/1/18. 
 

For those members who are eligible to participate in BWC's Safety Council Rebate Program this year, the following requirements must be met between 7/1/18 and 6/30/19:
  • Enrollment with safety council by 7/31/18.
  • Attendance at 10 Safety council meetings/events. At least 8 thru the local safety council. You can get credit for up to two meetings at BWC's safety training courses or other offsite industry-specific training courses/seminars. Certificates must be submitted to safety council no later than 6/30/19. Online courses do not qualify.
  • CEO attendance at one safety council sponsored meeting.
  • Submit semi-annual reports for the 2018 calendar year.
