FCC Grants INCOMPAS Request for Extension of Time in
UNE Forbearance Petition

On June 1, the FCC granted a request from INCOMPAS for an extension of time to file comments and replies in response to the USTelecom petition for UNE forbearance.
The petition in question would allow incumbent providers to escape their obligations under Section 251 of the Communications Act, which requires them to provide wholesale access to unbundled network elements (UNEs) and offer certain resale arrangements. UNEs and resale offer a means of competitive entry that spurs fiber building and innovation.
The deadline for filing comments is extended until August 6, 2018, and reply comments are now due September 5, 2018. The FCC also released a related protective order.
"Broadband competition is a national priority, and we commend Chairman Pai and the FCC for accepting our request to extend the comment period on this critical wholesale access proceeding," said INCOMPAS CEO Chip Pickering. "America's economy runs on access to networks, and competition keeps prices low and innovation high. The effort by AT&T/USTelecom to cut off competition from small broadband service providers will impact consumers, small business and schools across the country, including rural America. Cutting off wholesale access will hurt new network builders and the deployment agenda that all Americans crave."
He added, "We urge the FCC to reject the effort on its face and are pleased they have granted additional time to allow for public comment and more rigorous economic study. Many markets, including residential, business, education and rural are impacted by USTelecom's competition killer, making it critical that the Commission continue to ensure a thorough and thoughtful analysis throughout the proceeding." |

INCOMPAS Files Statement of Issues in Net Neutrality Case

On May 29, INCOMPAS filed a Statement of Issues in the U.S. Court of Appeals for the District of Columbia (D.C. Circuit) providing detail in its net neutrality challenge to the FCC's Restoring Internet Freedom Order.
The statement outlines how the FCC's Order abandoned its long-held, bipartisan jurisdiction to ensure an open internet, including the bright-line rules of no blocking, no throttling, no paid prioritization and strong
interconnection policies.
As a petitioner in the case, INCOMPAS is taking a leading role in the legal fight to save net neutrality on behalf of its member companies, including streaming services, internet edge providers and fiber broadband network builders.

FCC Announces Completion of Transition to New LNPA
|

The FCC last week announced the successful completion of the transition to the new Local Number Portability Administrator (LNPA), iconectiv. The LNPA operates the system that allows consumers to keep their telephone numbers when they switch communications service providers, thereby promoting consumer choice and competition among those companies. It also provides critical services to our nation's law enforcement and public safety communities.
