Osha Liang Partner is Elected 
HIPLA's New President

Carlyn Burton  was recently elected president of HIPLA (Houston Intellectual Property Law Association) - effective April 1st, 2019. Carlyn has been a member of HIPLA since graduating from law school. Regarding her new position within the association, Carlyn said, "m y primary objective for my term as president is to look at ways in which I can ensure the long-term health and growth of the association.  Programmatically, I am seeking to expand our events to include collaborations with the USPTO and other bar associations. I also look forward to further developing HIPLA's outreach, particularly to give our community's youth an early exposure to intellectual property. 
I mportant e-Commerce Venue Question Left Open - For Now

Companies accused of patent infringement remain in limbo after the CAFC's decision in  In re: Google LLC , in which the CAFC declined to decide whether a company's data servers located at independent Internet Service Provider facilities in a judicial district constitute that company's "regular and established place of business" in that venue for patent infringement venue purposes.

Copyright Lawsuits Must Satisfy Registration Approach

In Fourth Estate Public Benefit Corp. v. Wall-Street.com, LLC, the Supreme Court of the United States ended a split between the regional circuits over whether a copyright holder must first obtain a copyright registration from the United States Copyright Office, or if the act of filing an application for copyright registration was sufficient to bring suit in federal court.  The Supreme Court held that "registration" under 17 U.S.C. § 411(a) means the Register of Copyrights registered a copyright after examining a properly filed application, thus requiring a completed registration prior to a copyright owner enforcing a copyright in federal courts.   
AI COLLOQUIUM 

An In-depth Look at IP and Artificial Intelligence

FICPI, AIPPI and AIPLA held a joint colloquium on Artificial Intelligence on March 28-29, 2019. 
The Colloquium brought industry experts and leaders of the three organizations together  in 
the lovely city of Torino, Italy, to discuss current and potential impact of AI on IP laws.

Osha Liang managing partner  Jonathan Osha, in his role as Reporter General of AIPPI,  was 
one of the three Colloquium Coordinators along with Danny Huntington of FIPCI  and 
Chen Wang of AIPLA. He also moderated the panel on AI and patents, which  included outstanding speakers from five jurisdictions: Lili Wu, Hankun Law (China);  Thomas Kretschmer, IPrime Rentsch Kaelin AG (Europe); Takeshi Aoki, Primeworks  IP Attorneys (Japan); Jesung Ahn, AnK Intellectual Property (Korea), and Kate Gaudry,  Kilpatrick Townsend (USA).

At the conclusion of the Colloquium, a panel moderated by FICPI President Julian Crump 
led the attendees in an exercise to identify hot-button topics raised during the earlier 
discussions and to generate a list of policy issues for further consideration. 
An official report of the outcome of the Colloquium is forthcoming.

DUBAI CONFERENCE

AIPPI's First Regional Seminar in Dubai
 
AIPPI held its first-ever regional seminar in Dubai on March 25, 2019. The seminar 
covered a variety of topics relevant to local rights holders and practitioners and, 
through participation of AIPPI Bureau members, brought an international perspective to 
bear as well. Osha Liang managing partner Jonathan Osha spoke on the topic of copyright collecting societies on a panel moderated by Omar Obeidat of Al Tamimi & Co. 
He was joined by Hussain Spek Yoosuf of PopArabia, a leading music publisher and music 
rights consultancy in the Middle East and North Africa ("MENA"), and Aditya Verma, Sr. legal counsel and head of IP and anti-piracy at OSN, a leading pay-TV platform in the MENA region.  This was a particularly interesting topic locally because, despite copyright collecting societies being provided for by U.A.E. law, no such society is as yet operating in the country.
