Tip of the Week

Maintenance of and Access to Title IX Files

Tip of the Week authored by Brett A. Sokolow, J.D., Executive Director, ATIXA

On many campuses, the Title IX Coordinator maintains the records of all Complaints, Respondents, open and former Investigations and other related information. Should there be additional staff that might be provided access to these types of records? Should access to records such as these be outlined in a Sexual Misconduct Policy?

Click here to read the complete Tip.

Coming Next Week to All Current ATIXA Members

Coming next week, ATIXA will be releasing our first Member Survey. This is an exciting time for our association, as we look to learn from our Members!

Why a Member Survey? The purpose of the survey is to capture data from ATIXA member schools, colleges, and universities regarding the execution of Title IX practices and procedures. Your willingness to complete this survey will help us to provide our members with benchmark data pertaining to Title IX Administrators’ roles and resources in reference to Title IX compliance, including the implementation and development of formal policies, allocation of funding and other resources and administration of daily operations.

Keep an eye on your email inbox and make some time to offer us information that will help our members benchmark their programs against best practices, and make the case for the resources you need within your programs! Want to be a part of the discussion? Join ATIXA Today!

Our events now offer policy training, advanced investigator skills training at several levels, and expanded advanced coordinator track opportunities. This new dashboard allows for ease of use by identifying trainings by type, location and date.

Pre-conference opportunities include one-day events for Strategic Prevention, Title IX & Hazing and the ATIXA One Policy, One Process. We will also offer some great Advanced training options as two-day post-conference events.

As ever, we continue to refresh the content within each of our trainings, as well, to assure that it keeps you up-to-speed on the ever-changing nature of sex and gender discrimination within school and campus environments. Mandated Reporter Training for Employees: A Full-Service Online Training from ATIXA

Newly Revised and Updated for 2015 To Comply with all New Federal Regulations

In early 2014, ATIXA heard your requests and introduced its original version of this training tool. Today, in response to the newest rounds of federal regulation and guidance (VAWA Section 304 and the OCR Title IX Q&A from April 2014) and valuable feedback from our current users, we have re-designed this tool to better meet the needs of your campus. We've heard your requests for ATIXA to update and create the tool you need, and now you can train your employees with ease, online. This online training is designed to inform employees about their duty to report sexual abuse, sexual misconduct and other behaviors that fall under Title IX. Learn more here.

Final Eyes Service: Off-Site Investigation Review

You’ve come to the end of the investigation, hearing or appeal on a sexual misconduct complaint, and you want to be sure you’ve got it right. That’s what the experts at The NCHERM Group are here for. You’ll have the confidence that one of the nation’s foremost experts on Title IX has laid final eyes on your findings, sanctions and/or remedies, and thinks you are on the right track. Final-Eyes guarantees that an NCHERM Group partner will review your decision by phone and/or email, and let you know how they see it. Final-Eyes is the reassurance you need in a time when there is zero margin for error on campus sexual misconduct cases. This service is usually billed hourly, but instead you can subscribe to Final-Eyes for a flat-fee of $5,000 for the entire year, with no limit on how often it can be used. When your campus becomes a Final-Eyes subscriber, you will receive a coupon code for $500 off an institutional membership to ATIXA (discount is only valid for upcoming new and renewal memberships; cannot be combined with any other offer). Subscribe to Final-Eyes online or request an invoice. For more information, contact Alisha DiGiandomenico, Assistant Vice President for Client Relations, at (610) 644-3387.

Journal of Campus Title IX Compliance and Best Practices

The Journal of Campus Title IX Compliance and Best Practices (Campus IX) is the flagship, peer-reviewed journal of ATIXA. This journal will offer a space for Title IX coordinators, investigators and administrators to come together and explore emerging best practices, cutting-edge research, legal opinions and practical case studies relevant to the field of sexual assault prevention, investigation, remedies and response.

The journal will be launched for the ATIXA/SCOPE 2015 Joint National Conference with the call for submissions having been made during the ATIXA/SCOPE 2014 Joint National Conference. Article submissions are encouraged in a variety of content areas. These include:

  • Original research in the areas of campus sexual assault, investigation, coordination, administration. Preference will be give to studies that have generalizable results and are based on findings from multiple college and universities rather than a single school.
  • Case studies that provide clear teachable moments and illustrations for those working in the field.
  • Summary of law and policy and/or exploration of legal issues related to Title IX and sexual assault.
  • Discussion of policy and administration challenges and best practices.
  • Review of current prevention programs, investigation procedures or educational efforts.

Those interested in submitting an article should do so via email to the Campus IX managing editor, Dr. Brian Van Brunt, at [email protected]. Submission criteria are included here. Articles should be submitted prior to May 1, 2015 to be considered for publication in the 2015 edition of the Campus IX journal.

ATIXA Research Awards

Three $2500 research awards will be given to those creating new and innovative research in the field of Title IX Compliance and Best Practices. Research awards will be granted based on the scope of the study, the contribution to the field and advancement of best practices.

Those chosen for the research awards will publish their results in the Journal of Campus Title IX Compliance and Best Practices (Campus IX) and present their research during a 90-minute ATIXA online training.

Those submitting for research grants should complete the research grant application by April 1st, 2015. The application can be emailed to [email protected].

Model Clery Act ASR Language Now Available from ATIXA

Assisting in Compliance with VAWA Section 304

By now, many of you have taken a look at the VAWA Reauthorization section known as the Campus SaVE Act. This amendment changes the Clery Act in ways much more substantive than previous amendments. While amendments before asked us to disclose existing policies, they largely did not require us to create new policies except for the set of amendments contained in the 1992 Campus Sexual Assault Victim's Bill of Rights. Now, those disclosures and rights have been largely eclipsed by the SaVE amendments, which will require us to develop significant new policy language, much of the content of which is prescribed by the SaVE Act. Final regulations were released in October 2014 by the Negotiated Rulemaking Committee, requiring changes to the Clery Act effective July 2015. Start planning now, because there is a lot to this new law.

We have a shortcut to SaVE you time. We have created template language to satisfy all of the new SaVE Act disclosure requirements - at least as best we can decipher them before final regulations are announced later this year. It's six pages of model language containing policy and procedure information outlined by Title IX and Campus SaVE, and is compliant with the most recent draft regulations of the VAWA Section 304 regulation. This template is available from The NCHERM Group for $249. To purchase our SaVE disclosure template, visit our online store or contact Michelle Issadore at (610) 993-0229, extension 1002. Please note that our template only includes the new ASR required disclosures, not all updates that were made by SaVE, such as those involving hate crimes statistics and hate crime categories. Please also note that purchasers will receive all updates made to the template language, so you can be assured that you will always have our most current version at hand.
