President's Message

It’s finally here. After seven months of waiting, football is back. No more “wait until next year!” Next year is here! We kick off the season with our annual Danny Sheridan Football Preview lunch August 16 th . It is the most well-attended lunch meeting of the year, and you don’t want to miss it. While you’re preparing for the season by reading your copies of Athlon Sports and Lindy’s Sports (a Cumberland Law School classmate of mine, by the way), here are some great quotes by famous coaches who knew how to coach people, not just football. Hopefully, some of these quotes can help you stay motivated in your law practice, not just your fantasy league.

The lazy days of summer will start to fade away as we enter the month of August. We have a busy August planned and will offer a variety of ways for you to get involved with the Mobile Bar Association. If you didn’t get a chance to join us for the opening of the Justice Exhibit on Tuesday, July 30th, please stop by and view it. It is located in the atrium area of Government Plaza and will be on display until September 19th. 
 
On August 8 th , our mentoring committee will once again hold their Coffee with the Court. 2019 MENTORING PROGRAM
Coffee with the Court
The Mentoring Committee is offering a program for 2019 called Coffee with the Court .  The concept is to provide a forum for our members to get to know our local judges over a cup of coffee.  At each session, two to three judges will present on the topic: My Top 5 Practice Pointers for Newer Lawyers in my Courtroom . All participants receive one hour of CLE credit, as well as coffee.  There is no cost for Mobile Bar members with 12 years of experience or less.  We welcome all other Mobile Bar members and non-members to join us, and standard CLE rates are charged.  Space will be limited. We are asking everyone to register in advance.  

We have three more programs in 2019 from 7:30 a.m. to 8:30 a.m. at The Admiral Hotel in the Cove Room. It is a small meeting room on the first floor near the restaurant. Again, we are asking everyone to REGISTER IN ADVANCE .

In Ex parte Mi. G., No. 2180566 (Ala. Civ. App., June 21, 2019), the Court of Civil Appeals held that a trial judge was not required to recuse himself in a case where it was possible, but not certain, that the judge might be a witness in proceedings related to a Judicial Inquiry Commission complaint filed against another judge by the attorney for the moving party.

In a case of first impression, the Supreme Court in Deutsche Bank National Trust Co. v. Walker County , No. 1160926 (Ala., June 28, 2019), held that Ala. Code § 35-4-50, which provides that “[c]onveyances of property, required by law to be recorded, must be recorded in the office of the judge of probate,” does not “require” that mortgages be recorded to be valid. Rather, it merely specifies that any conveyances of real property, for which there is a separate requirement of recordation, must be recorded in the probate court. In effect, the opinion upheld the longstanding understanding that while there were certain legal benefits to recording a conveyancing instrument, such recording was not legally mandatory.
 
In Cox v. Parrish , No. 1170391 (Ala., June 21, 2019), the Supreme Court held that a trial court was without jurisdiction to enter a Rule 54(b) certification of an order as a final judgment when it was undisputed that remaining unresolved claims in the case might, when resolved, render moot the claims for which final judgment certification was made.
 
In a case of first impression, the Court of Civil Appeals in Langley v. Farrar , No. 2180058 (Ala. Civ. App., June 28, 2019), held that the Defendant’s Rule 60(b)(4) motion should have been granted where the complaint listed the wrong address for Defendant, the Defendant stated his correct address in the answer, but where the trial court purported to notify Defendant of a trial date by sending the notice to the incorrect address and the Defendant did not know of the trial proceedings. Accordingly, the judgment subsequently entered as the trial at which Defendant had not appeared was due to be set aside due to lack of notice.

LAWYERS HELPING LAWYERS

Well-being is difficult to define. In fact, although there is general agreement supporting the notion of well-being, there is no consensus as to its definition because experiencing a sense of well-being is very subjective. Among the many basic elements that constitute a sense of well-being are good health, possessing positive social/familial relationships, the ability to meet basic needs for one’s self and family, a sense of fulfillment, and a sense of satisfaction with one’s life. A sense of well-being is a very dynamic process.
 
As the diagram shows, a multitude of basic elements comprise the major dimensions that combine to form our overall sense of well-being. When one or more of these dimensions are adversely altered or threatened, there is a negative impact on our overall sense of well-being. Abuse of drugs or alcohol is a major threat to our sense of well-being because such abuse, if left unaddressed, eventually affects every major dimension of our lives. Therefore, a disruption in our overall sense of well-being may be the harbinger of more serious life issues.
If you are experiencing issues with drugs or alcohol, you are not alone. In our legal community, there is a strong network of lawyers helping lawyers. This help is offered anonymously.  Approximately 15 years ago several attorneys from Mobile and Baldwin Counties formed the group Lawyers in Recovery (“LIR”). Every LIR meeting starts with the recitation: “Who you see in a LIR meeting, what you hear in an LIR meeting, stays in the LIR meeting.” Further, LIR is not aligned with, nor does it report to, any other group or entity (i.e., the Alabama State Bar or the Mobile Bar Association or Committees of those Organizations). To the contrary, and as stated in its Preamble, “LIR is a fellowship of lawyers who share their experience, strength and hope with each other to hopefully solve their common problems and help others to recover from alcoholism, addiction, depression or similar conditions.” 
Lawyers in Recovery (“LIR”) is a fellowship of lawyers who share their experience, strength and hope with each other to hopefully solve their common problems and help others to recover from alcoholism, addiction, depression or similar conditions. LIR meetings are designed to last one hour and start promptly at 5:30 p.m. on the first and third Thursdays of every month at 205 Church Street in Mobile. LIR meetings are modeled on the steps and traditions of Alcoholics Anonymous and participants pledge and place substantial emphasis on anonymity. If anyone needs additional information on LIR Meetings, they can anonymously call the Mobile Bar Association office for referral to a LIR Member who will also keep all communications confidential.

ARCHIVES AND HISTORY

This is a continuing discussion of the video interviews the Archives & History Committee has conducted over the past five years that are accessible on the Mobile Bar Association website for both attorneys and the public. In 2016, our Committee had the privilege of interviewing Robert Edington, Esq., who was 86 years old at the time. He was admitted to the Mobile Bar Association in 1956.

Robert Edington served in the U. S. Navy from 1951 to 1955 in the West Pacific Fleet. He remained in the U. S. Navy Reserve and retired with the title of Commander in 1980. He was elected to and served in the Alabama House of Representatives from 1962 to 1970 and in the Alabama Senate from 1970 to 1974. He also served on the Alabama State Democratic Executive Committee for four years during that time. During his eight years of service in the Alabama House of Representatives and four years as a Senator from Mobile County, Robert Edington aided in the legislation that established the Alabama Historical Commission, the U.S.S. Alabama Battleship Commission and various historic districts in the City of Mobile. For his legislative efforts, Edington received a national award from the National Trust for Historic Preservation in Washington, D.C. While in the Alabama legislature, Edington also co-sponsored legislation for the creation of the University of South Alabama and the USA College of Medicine.

For 20 years, Edington served as the Consul of Guatemala in Mobile and organized the first local trade mission to Central America. For more than 40 years, he participated in the coordination of U. S. Navy Ships for Mobile’s Mardi Gras Festivities. Edington is a Member of the Kiwanis Club of Mobile and has served as an Elder at Spring Hill Presbyterian Church. He is married to Pat Edington and they have two children, Sherard, a Presbyterian Minister, and Virginia, a businesswoman in Daphne. He and his wife, Pat, have regularly attended the National Democratic Conventions as representatives from the State of Alabama for many years. I believe our Committee’s interview of Robert Edington will be of great interest to the members of the Mobile Bar Association.
BORN: MBA Member Greg Vaughan and wife Tonya welcomed son Samuel Edward on July 10, 2019. At 20 inches long, Samuel weighed 7 pounds and 12 ounces. Samuel joins big sister Ansley Elizabeth.

MBA Past President and Armbrecht Jackson partner Kathy Miller was recently appointed Norway's Honorary Consul for the State of Alabama.

MBA Member and Armbrecht Jackson partner J. Robert (“Robbie”) Turnipseed was recently elected as a Fellow to the American College of Tax Counsel (“ACTC”), which is a national association of tax lawyers who have been recognized by their peers as making exceptional contributions to the tax profession.

Burr & Forman Mobile partner John Browning was recently elected to serve as vice-chair to the Business Litigation General Committee of the TIPS Section for the American Bar Association (ABA). In addition, he was elected to serve on The Brief Editorial Board Standing Committee. He will serve a one-year term for both positions for the 2019-2020 board year.

UPDATE
Plans are well underway for the 2019 Tri the Gulf and we need YOU to get involved. Tri the Gulf is a sprint triathlon held on Dauphin Island, Alabama. The course consists of a 600 yard Gulf swim, 16.7 mile island + bridge bike and 3.1 mile island run (short section off road on the golf course). This triathlon is produced by the Mobile Bar Foundation.
