Two New Trainings Now Available from The NCHERM Group, LLC

Civil Rights Investigation Clinical Skills Training

Available as a One or Two Day Course

Day One

Fully process and resolve a sexual harassment complaint (faculty-on-student). This training will have participants model the entire process of resolution in a clinical setting with feedback from the presenters and audience. The allegation will be processed through intake, and then to the Title IX Coordinator. Then, a small “i” preliminary inquiry will be conducted. From there, the allegation will be referred to an investigation team (or multiple teams, depending on the training group size. The team(s) will conduct interviews, gather evidence, assess and analyze and recommend a finding. The training is based on a fully scripted case study where multiple individuals will play roles as intake personnel, the Title IX Coordinator, investigators, witnesses, parties and advisors. The allegation will be processed from start to finish, with expert guidance and feedback from the presenter(s) along the way, and an opportunity for the group(s) to debrief their findings and process together at the end of the day.

Day Two

Report writing clinic. Day two can stand alone or be combined with day one to write the report based on the case study from day one. This training will start with discussion of the anatomy of an investigation report. The training will then address each section to include within a report, writing style, credibility assessment, analysis, and finding. Working from the sexual harassment case study script, participants will then write report sections and share for group editing with input from other participants and gentle critical feedback from the expert facilitator(s). Examples of report sections written by the facilitator(s) will be shared and discussed as well. Participants will receive sample template reports for a variety of Title IX covered behaviors as part of the materials for this training.

Announcing the Release of New Versions of the ATIXA One Policy, One Process Model

Model Policies

The NCHERM Group and ATIXA Model Policy and Procedure for Civil Rights Equity Grievance Resolution for all Faculty, Students and Employees

ATIXA has freshly revised its One Policy, One Process (1P1P) unified resolution model for all forms of campus discrimination. It’s fully up-to-date with all legal and regulatory changes, and incorporates additional changes that resulted from extensive focus group feedback. Moreover, there are now three versions of 1P1P available as well as special versions that are compliant with both the NY and CA consent statutes.

 

The three standard versions of 1P1P are:

Version One – The ATIXA One Policy, One Process Model, Investigation-Only*
Investigation -> Coordinator-Implemented Resolution

Version Two – The ATIXA One Policy, One Process Model, Investigation-Only with an Appeal
Investigation -> Appeal -> Coordinator-Implemented Resolution

Version Three – The ATIXA One Policy, One Process Model
Investigation -> Hearing -> Appeal -> Coordinator-Implemented Resolution

*Please consult with your legal counsel to determine which version of 1P1P is best for your campus. In some jurisdictions, courts could find that Version One – Investigation -> Coordinator-Implemented Resolution may not provide sufficient due process for a public university. We believe that all three versions provide sufficient due process, but courts are still on a learning curve when it comes to the innovation of civil rights models in higher education. Versions Two or Three should be evaluated instead.

This document is intended to outline the College’s policy regarding mandated reporting of concerning behaviors, discrimination, harassment and crimes by employees. It explains briefly the meaning and purpose of mandatory reporters, outlines the legal context, and articulates a straightforward set of guidelines for all employees to follow. Download here.



Complying with Campus SaVE and VAWA Section 304

By now, many of you have taken a look at the VAWA Reauthorization section known as the Campus SaVE Act. This amendment changes the Clery Act in ways much more substantive than previous amendments. While amendments before asked us to disclose existing policies, they largely did not require us to create new policies except for the set of amendments contained in the 1992 Campus Sexual Assault Victim's Bill of Rights. Now, those disclosures and rights have been largely eclipsed by the SaVE amendments, which will require us to develop significant new policy language, much of the content of which is prescribed by the SaVE Act. Final regulations were released in October 2014 by the Negotiated Rulemaking Committee, requiring changes to the Clery Act effective July 2015.
