A Developmental Framework for a Code of Student ConductThe NCHERM Group Model Code Project

Six higher education law and policy experts have collaborated to offer a new model code of student conduct to the field. You can access the free model with this link, and we also invite you to contribute to our open-source code Wiki project, which allows the entire field to contribute to, critique and strengthen this model. Access the Wiki here. You'll find this model a substantial departure from previous model codes, while it also builds on their significant foundations. We hope you will find our model useful in your future code revision efforts. The NCHERM Group continues to offer custom code writing and revision services if you prefer our expertise in tailoring our templates to your unique campus culture. Variations on the model code for private colleges and community colleges are also available. Please contact The NCHERM Group for details.

ATIXA Mandated Reporter Training for Employees

The Title IX OCR Dear Colleague Letter (April 4, 2011) tells us we must train all of our employees on reporting responsibilities. How are we supposed to do that? We’ve heard your requests for ATIXA to create the tool you need, and now you can train your employees with ease, online. ATIXA has developed an online, comprehensive training tool designed to inform employees about their duty to report sexual abuse, sexual misconduct and other behaviors that fall under Title IX. This training can be used in large groups or individually, and is appropriate for all employees, including staff, administrators and faculty.

The training covers reporting of sex and gender discrimination incidents, including sexual harassment, sexual assault, bullying, stalking and related behaviors, thus satisfying the expectations of Title IX and Title VII. It also addresses the reporting of crimes and crime statistics for Clery Act compliance, when those crimes intersect with Title IX and Title VII (as in the case of sexual assault). Click here to learn more about this new training opportunity from ATIXA and The NCHERM Group.

Resource Spotlight

Title IX: The Basics

Published by Know Your IX, 2013

Know Your IX is a campaign that aims to educate all college students in the U.S. about their rights under Title IX. Its purpose is to arm sexual violence survivors with information to help them advocate for themselves during their schools’ grievance proceedings and, if Title IX guarantees are not respected, file a complaint against their institution with the Department of Education’s Office for Civil Rights. They have published a website, PDF, and video of nine things to know about your Title IX rights and an institution's responsibilities.

Tip of the Week

What is our obligation under Title IX pertaining incidents at an off-site internship, clinical rotation when we do not have a written agreement in place with the host site?
Tip of the Week authored by Daniel C. Swinton, J.D., Ed.D., Associate Executive Director, ATIXA

If an institution learns of harassment that occurs at one of these sites, the institution should still conduct a preliminary inquiry to see whether there is sufficient information or evidence for the institution to address the situation. Under Title IX, an institution has an obligation to address behavior when the institution has control over both the harasser and the context of the harassment. Chances are, when there is no written agreement or MOU in place, your control over the context of the harassment and the harasser is probably negligible. Accordingly, focus on what you can control.

Are Your Campus Policies and Procedures Title IX Compliant?

You've worked diligently to update campus policies and procedures since April of 2011, to be sure that your campus is meeting the mandates of Title IX. But, Title IX compliance is a moving target. There have been three additional Dear Colleague Letters since then, as well as six OCR-publicized campus compliance reviews. If you want to be sure your policies and procedures are compliant with all of the regulatory documents, our Title IX Policy and Procedure Review Service is the cost-effective reassurance you need. Our reviews can be turned around in just two weeks and provide you with a "redline" commentary on your documents from the experts at The NCHERM Group. Our consultants have not only authored model policies to address discrimination under Title IX, but policies and procedures we have written for colleges and universities have repeatedly passed muster when reviewed by OCR. Maybe your campus uses our model, but do the changes you've made to our templates still meet the mandates of the law? We know what to look for, and we'll make sure your policies and procedures don't miss a thing. Call Alisha at (610) 644-3387 today for details.
