Successful REALTOR® Day at the Capitol
Tuesday, April 2nd was a busy day at the Oregon Capitol! Thank you to the hundreds of REALTORS® from across the state who came to support REALTOR® Day at the Capitol. Our group had the largest tent to date and we filled it up quickly. The morning program began with welcome remarks by OAR's CEO Jenny Pakula, OAR's 2019 President Nan Wimmers and Adam Schwend, Political Affairs Committee Chair. The program continued with Shawn Cleave, OAR's Government Affairs Director and Shaun Jillions, Chief Lobbyist, reviewing legislation that could effect the real estate industry.

Then the fun really began as the entire room divided into groups based on their legislative district. This was their opportunity to review the bills and prepare questions for the meetings with their Legislators. Soon after, we welcomed special guest, Governor Kate Brown. She reviewed her priorities and acknowledged agreement with many of our positions.

After a BBQ lunch, REALTORS® headed across the street to meet with their Legislators inside the Capitol. REALTORS® met with both their Senators and House Representatives to discuss current issues, share local stories and voice their concerns.

It was truly an incredible day filled with networking, education and advocating for homeownership and private property rights. We are very thankful for your commitment to the real estate industry.

Debra is the Oregon Designated Principal Broker for eXp Realty, LLC and co-owner of Fisher Nicholson Realty in Klamath Falls. She has over forty years of real estate experience and has been heavily involved in all levels of the REALTOR® organization at local, state and national levels. REALTORS® Are Good Neighbors
Bert Waugh Jr - Berkshire Hathaway HomeServices Northwest Real Estate is being featured this month on NAR’s new Facebook page, Realtors are Good Neighbors. This new page promotes stories of REALTORS® who are doing incredible things to help the community thr ough volunteer work. Bert started a non-profit, Braking Cycles , to help homeless teens through through transitional housing, job training, scholarships and an outreach center. Nominate a REALTOR®
Are you or someone you know doing great work serving the community? NAR wants to hear about it! Submit your application by May 10, 2019 to be considered for a Good Neighbor Award. Good Neighbor Award winners receive $10,000 grants for their charities, as well as national and local publicity for their cause. Winners will also be flown to the National Association of REALTORS® annual conference where they will receive their award in front of thousands of fellow REALTORS®. Asbestos Survey Requirements
Oregon adopted new requirements in fall 2018 for handling asbestos. The Oregon Department of Environmental Quality requires property owners and contractors to identify asbestos and to properly handle, package and dispose of asbestos waste from demolition and renovation projects.  A new requirement that is applicable to the real estate industry is the new  residential renovation survey requirement . RPAC National Competition
The results are in for the 2019 RPAC state competition and Oregon is the Runner Up for dollars raised. NAR raised more than $94,000 for RPAC and had more than 350+ online investors during the March competition.

LEGAL HOTLINE Q&A
Question: I have a broker with a seller who would like to offer his property for rent. The broker would like to place a for rent sign on the property, with their name and number listed as the contact. In the event a prospective renter contacts him, the broker would simply provide the seller’s contact information and step aside so the seller/landlord and prospective tenant could negotiate an agreement and conduct business entirely between themselves. Would this be considered property management from the Real Estate Agency’s perspective?

Answer: Advertising the property for rent is “property management” under real estate law.  That alone will make your company subject to all of the rules that apply to property management. You will not need to register or pay any additional fees, but you will have to meet all of the administrative rules that apply to property management activities. Those rules are found in Oregon Administrative Rules Chapter 863 Division 25. Read the rules before undertaking any property management functions and remember that any property management activity no matter how small or friendly kicks in the property management rules for your brokerage. If you don’t do property management  and don’t want to start, a referral to a property management company is always the safest course, particularly in light of recently passed legislation.

The Oregon Association of REALTORS® Legal Hotline provides subscribers the opportunity to ask real estate-related questions of an attorney specializing in real estate and contract law. OAR can advise member subscribers on a variety of topics including disclosure, license law, contracts and offers.

The cost for a one year Legal Hotline subscription is $125 per individual subscription. The Legal Hotline is open Monday – Friday, 9:00 a.m. to 12:00 p.m. (except during NAR & OAR conventions and holidays). Subscribers may e-mail questions to the Legal Hotline at any time and can expect an answer within 24 hours (excluding weekends and holidays). Changes in license status or brokerage will not affect an individual's subscription or access to the Legal Hotline.
