"In the late 1960's several Court cases held that Cable retransmission of the programs broadcast by TV Stations did not constitute a "performance" of those programs under the then extant 1909 Copyright Act. The Supreme Court urged the Congress to write a new law. And the Congress urged the Broadcasters, Cable companies and Programmers to agree on a framework for a new law. In 1972, at an historic meeting where I was present (as a young Law Student), the three industry segments reached the "Consensus Agreement". A copy of that Consensus Agreement can be found as Appendix B to a 1992 Report Of The Copyright Office.

I haven't yet polled the industry, nor asked about this pipe dream of eliminating MVPD must carry. Almost all I know would want the opposite, to feed on the corporate welfare the full power stations are granted from last century. But as we all have seen, this industry is now starting to move fast into the future, with all kinds of M&A activity, mergers failing, rules being tested to the limits and beyond, and now with this bill.
This is what happens when you are part of a suppressed class of businesses within a rigged economic model. Don't forgot that anything is possible as defined by highest and best use for the public good. If must carry is phased out over time, our 3.0 enabled bit delivery pipes will get leased to the max, and it will not matter if an MVPD gets the stream from us or any other part of the 5G world.
The Dem's will also have a big say about any systemic change to the broadcast rigged economy. I do believe if we are invited to the policy table, our positions will prevail, and we will get a favorable deal. Why? Sheer size and the density of coverage we provide. While for decades we sculpted, contoured, and adjusted our coverages to fit in between the full powers, we now control the national, regional, and local interconnections along many highways, and between most TV DMA.
It is just the nature of our historical filings.
