Killer Contract Clauses

The typical construction or service contract can contain thirty pages or more of fine print. Some contract terms in particular can severely impact your rights and, once enforced, can directly affect profitability. These contract clauses may impact payment rights, notice responsibilities, scope changes, and the right to recover for costs resulting from project delays. Cohen Seglias attorneys Matt Gioffre and Dan Fierstein will present a seminar explaining these Killer Contract Clauses, how courts will interpret and enforce them, and will provide best practice tips for managing a project to minimize the impact of these contractual provisions.

Reminder Regarding LU 420 and LU 690 Apprentices
The PA Primary Election is coming up on Tuesday, May 15, 2018. Please be aware that all Local 420 and Local 690 Apprentices will be pulled from their job sites at noon on this day and will report back to their respective local to be given a polling place assignment.
New LU 420 & LU 690 Wage Sheets
Linked below are the the LU 420 and LU 690 Wage Sheets. They became effective as of May 1, 2018 with the exception of the LU 420 Service Rates, which will become effective on May 15, 2018. If you have any questions, please contact the Association office.
M&SCA Members Learn the Benefits of Cogeneration at CTCA's Philadelphia Facility
On Friday, April 13, labor and management representatives from Steamfitters Local 420 and M&SCA of Eastern PA, public and private energy partners, and local and community leaders came together for a luncheon and presentation on how CoGeneration can benefit facilities and reduce energy costs. The presentation was held at Cancer Treatment Centers of America (CTCA) in Philadelphia who, over the past two years, has gone through the process of implementing this cost-efficient and environmentally-friendly option. Advocacy Updates
PES Refinery Update
A recent court hearing confirmed the settlement between Philadelphia Energy Solutions and the US Department of Justice on behalf of the Environmental Protection Agency to alleviate a portion of the RIN burden from 2017. This is a big victory and a crucial step in saving thousands of refinery jobs in our area.  We called on M&SCA of Eastern PA Contractors to participate in the open comment period and received a fantastic response from several members showing support for PES. This unified response is a perfect example of what our membership can do when we take action on issues affecting us on a local, state, or national level. Material Price Increase Relief
Members can click here to view the newest MCAA Management Methods Bulletin. It covers potential approaches Member Contractors can consider in attempting to recover price increases on steel and aluminum resulting from the Administration's recently imposed tariffs. It also includes a sample price escalation clause for future contracts.

M&SCA Supports Senator John Rafferty
M&SCA's Tim Brink and Catie Scott, Senator John Rafferty, & M&SCA PAC President Jim Gaffney.
On Monday, April 30, M&SCA of Eastern PA and NECA Penn-Del-Jersey co-sponsored a fundraiser for Senator John Rafferty of PA's 44th Senate District. Senator Rafferty is currently running for his fifth term and serves as the Chairman of the Senate Transportation Committee. The most lauded accomplishment during his tenure to date was spearheading the passage of Act 89 of 2013, which created a multi-billion dollar, multi-modal transportation funding plan for Pennsylvania. He is now advocating on our behalf for Prompt Pay (HB 566), which currently remains in the Senate awaiting a full vote.
May OSHA Focus Four: Fall Hazards
The Focus Four Hazards have accounted for the vast majority of injuries and fatalities in the construction industry. In an effort to prevent future injuries and fatalities, OSHA, our state plans, consultation projects, and construction industry partners have initiated a “Focus Four Hazards” campaign from March through June in Region Three’s jurisdiction.  The goal of this campaign is to raise awareness in the recognition, evaluation, and control of these hazards through the delivery of toolbox talks for employers to provide to their workers. The month of May focuses on Fall Hazards. Using the link below, you'll find handouts, guides, and activities for your employees that will help them reduce the occurrence of these hazards.
