Arbitration Agreements Are Not For Everyone
 
You may have heard about the recent U.S. Supreme Court decision allowing employers to enforce Arbitration Agreements in employee contracts. When this first came out, we received a number to client emails asking for this to be added immediately.
 
For some larges clients, this may, in fact, be a welcome addition to their policies and procedures. After all, arbitration is viewed as more factual and takes the case out of the hands of juries that may look upon the big, bad employer as the root of all evil. It also may be less expensive as punitive damages may be more in line with actual losses. [...]

Improve Tracking of Workplace Injuries & Illnesses Regulation
 
In 2016, OSHA developed a database for capturing all OSHA recordable occupational injuries and illnesses. The regulation requires ALL employers with 250 or more employees, and companies in 68 specific targeted industries with 25 or more employees, in the United States and it's Territories to start using an online system to document all the recordables through this system. Cal/OSHA and several other State OSHA programs delayed implantation for adoption into the State's programs.

On April 30, 2018, OSHA issues a notice notifying all State programs that as of July 1, 2008, employers in their state are to start using this online database for OSHA occupational injuries and illnesses that meet the recordable criteria. As stated in the notice "OSHA determined that Section 18(c)(7) of the Occupational Safety and Health Act, and relevant OSHA regulations pertaining to State Plans, require all affected employers to submit injury and illness data in the Injury Tracking Application (ITA)online portal, even if the employer is covered by a State Plan that has not completed adoption of their own state rule."
