#MeToo and the New Tax Law: Beware Of The Unintended Consequences

As the dust settles from the recent legislative collision between the #MeToo movement and tax reform, it is the proponents of the #MeToo movement that are left scratching their heads and crying foul. In what was intended to help shine a spotlight on, and assist in the eradication of, workplace sexual harassment, the 2017 Tax Cuts and Jobs Act includes language prohibiting the deductibility of (1) any settlements or payments related to sexual harassment or sexual abuse if such settlement or payment is subject to a nondisclosure agreement (NDA) and (2) attorney's fees related to such settlement or payment.   Read more.
There is No Such Thing as "Boilerplate": Protecting Equity and Deferred Compensation

Typically, an executive separating from employment is asked to sign a severance agreement in exchange for severance. Updated Equal Pay Act, Effective July 1, 2018

On July 1, 2018, the new Massachusetts Equal Pay Act takes effect.  The Office of the Attorney General has published an overview of the new law and answers to frequently asked questions which is available,  here .

Sexual Misconduct and the Definition of "Cause"

The Balles v. Babcock Power Inc. decision sheds light on whether sexual misconduct constitutes "cause" and provides go-forward guidance to all parties drafting and negotiating (or re-negotiating) "for cause" language in employment and compensation agreements. Read more.

Brian J. MacDonough quoted in Massachusetts  Lawyers Weekly article, " Good faith not enough to rebut FMLA claim," on April 12, 2018


Boston attorney Brian J. MacDonough said the case was a good reminder of the compensatory nature of liquidated damages.

"A lot of times they are looked at as punitive, but they are not," he said.

The DaPrato case, along with another recent decision in federal court (see sidebar), also serve as reminders to employers that they should not "elevate form over substance" when trying to adhere to written policies. At times, with laws like the FMLA, such policies need to be applied flexibly to comply with the statute, he said.
